The available reporting does not establish that Saskatchewan ticketed a driver simply for using the McDonald’s app in a drive-thru. Mason Prima of Saskatoon said he used his phone in a McDonald’s drive-thru to load a promotional code. The RCMP said an officer instead saw him using a cellphone while driving on a public roadway, before he entered the restaurant property.
What happened
The incident was reported as occurring on May 13, 2024. Prima said he took out his phone to open the McDonald’s app and load a code for a free meal while he was in the drive-thru. He said a motorcycle officer approached his vehicle and issued a cellphone-related ticket.

According to contemporaneous reporting, Prima planned to contest the ticket, with a court date reported for July 31, 2024. The account was summarized by MobileSyrup, citing CTV News.

The RCMP disputed the description of the incident as a drive-thru cellphone ticket. Its account was that a Combined Traffic Services Saskatchewan RCMP officer observed Prima using a cellphone while he was driving on a public roadway. The RCMP said Prima then pulled into the McDonald’s parking lot, where the ticket was issued.

That distinction matters. The place where an officer hands over a ticket is not necessarily the place where the alleged offence occurred. On the available information, the evidence does not independently resolve where the phone was being used when the officer first observed it.
In short:
- Prima’s account: he used the app while stopped or moving slowly in the drive-thru.
- The RCMP’s account: the cellphone use occurred while he was driving on a public roadway, before he entered the McDonald’s property.
The police account is not a court ruling, and the driver’s account is not an established finding. The exact ticket wording and any supporting evidence would be necessary to determine what was alleged.
What Saskatchewan’s distracted-driving rules generally prohibit
Saskatchewan’s distracted-driving framework restricts cellphone use while driving. SGI materials describe prohibited conduct including activities such as talking, texting, emailing and surfing the internet. The province’s SGI distracted-driving backgrounder provides useful background.

The legal questions in a case like this can include:
- What the current law means by using or operating a cellphone or electronic device.
- Whether the relevant prohibition applies to a “highway” or public roadway and how Saskatchewan defines that term.
- Whether the particular private parking lot or drive-thru is covered.
- Whether a vehicle that is temporarily stopped is still legally being driven.
- Whether the driver was using the phone by hand, through a permitted hands-free setup or in another way covered by an exception.
Does a drive-thru make cellphone use legal?
Not automatically. A drive-thru is private property, but it is also a lane designed for vehicle movement. That is different from being properly parked in a designated parking space with the vehicle safely secured.
Private ownership does not mean that all traffic-related rules disappear. Police enforcement, property rules and other driving offences may still be relevant. Conversely, it would be too broad to say that every handheld-phone action in every drive-thru automatically violates Saskatchewan’s cellphone law without applying the current statutory definitions and the facts of the individual case.

Engine status is not a universal test, and a phone mounted in a cradle or controlled by voice may have different legal treatment from a handheld phone—but those distinctions can have conditions. A passenger holding the device also does not necessarily answer whether the driver was participating in the prohibited use.

The most important factual issue here may therefore be the alleged roadway use before the restaurant, rather than the fact that the ticket was delivered on McDonald’s property.

The available sources establish that a July 31, 2024 court date was reported as planned. They do not establish whether the charge was withdrawn, dismissed, upheld or otherwise resolved.
Readers should not treat social-media discussion as proof of the result. For a reliable disposition, the relevant ticket, court record or official court confirmation would be needed. Saskatchewan Courts’ media guidance explains that court staff can assist with basic requests such as case status, next appearance dates and dispositions, and that written Saskatchewan decisions are available through CanLII.

What drivers should do
The safest approach does not depend on resolving the legal boundary:
- Load coupons, loyalty codes, payment details and mobile orders before entering the roadway or drive-thru.
- Ask a passenger to handle the phone where possible.
- If you must use the phone, pull into a legal parking space, stop safely, secure the vehicle and follow the current law.
- Do not handle the phone while approaching or leaving the restaurant, even if the intended action is only to display a coupon.
- Do not assume that slow movement, a temporary stop or private property makes handheld use lawful.
Bottom line
This incident does not establish a blanket rule that using the McDonald’s app in a drive-thru is itself an offence. Prima described a drive-thru cellphone ticket; the RCMP said the alleged use happened while he was driving on a public roadway. The answer depends on the exact offence alleged, the current Saskatchewan law, the location and manner of use, and the evidence about what happened before the vehicle entered the restaurant property.
