Rivian said in October 2025 that resolving the case would let it focus resources on the R2, but it denied wrongdoing, and the settlement was not a finding that the allegations were true.
What the lawsuit alleged
In Crews v. Rivian Automotive, Inc. et al., investors alleged that Rivian’s initial public offering documents and certain later investor statements omitted material facts and risks. The settlement notice describes one central allegation: that the bill-of-materials cost of Rivian’s R1T and R1S vehicles exceeded their offered prices, leading the company to raise retail prices. Rivian’s October 2025 announcement said the claims were brought for purchasers of its Class A common stock from November 10, 2021, through March 10, 2022. Rivian announcement
What Rivian agreed to pay—and why
On October 23, 2025, Rivian announced it had agreed to a $250 million settlement. The company said the amount would be funded with $67 million from directors’ and officers’ liability insurance and $183 million from cash on hand. Rivian said settling would enable it to focus resources on launching the mass-market R2 in the first half of 2026. That was the company’s stated rationale; it does not establish that the lawsuit otherwise would have delayed production, affected engineering, or changed the vehicle’s launch outcome. The settlement is no longer just proposed
Rivian’s October 2025 announcement said the proposed settlement needed court approval. In its June 2026 quarterly filing, Rivian reported that the court granted final approval on May 20, 2026, and entered judgment on May 29, 2026. The case had therefore moved from an announced agreement awaiting approval to a finally approved settlement by the time of that filing. Rivian SEC filing

What happened to the R2 launch
The original “next year” framing referred to the period after Rivian’s October 2025 announcement. The company’s subsequent updates show that the R2 moved into production and customer deliveries during 2026:
- April 22, 2026: Rivian said R2 production had started. Initial vehicles were undergoing internal final quality and validation checks, and the company said it was on track for first customer deliveries later that spring. Rivian production update
- June 9, 2026: Rivian said invited reservation holders could begin ordering the Performance with Launch Package configuration. It then described Premium as expected in late 2026 and Standard in 2027. Those were company plans at the time, not guaranteed availability dates; invitation access and configuration availability can change. Rivian ordering update
- Second quarter of 2026: Rivian’s earnings presentation reported that R2 deliveries had begun during the quarter, alongside the start of production in Normal, Illinois, and the ramp of the first production shift. Rivian Q2 2026 earnings presentation
These updates establish that production and deliveries began; they do not establish current inventory, pricing, delivery windows, or the present schedule for every trim. Those details can change, so buyers should verify them in Rivian’s current ordering information.

R2 ramp costs are separate from the settlement
In its June 2026 quarterly filing, Rivian reported approximately $100 million in incremental cost of revenues associated with ramping R2 production, comparing the three and six months ended June 30, 2026, with production at more normalized levels. That is a reported production-ramp cost, not part of the $250 million settlement or a measure of the settlement’s effect on Rivian’s finances. Rivian quarterly filing
