NHTSA has announced a negotiated rulemaking to review the federal vehicle-lighting standard, FMVSS No. 108. The October 6, 2026 announcement identifies five topics for discussion—from glare to international alignment—but does not establish new requirements or say when a final rule might arrive.
What NHTSA announced—and what it did not
The National Highway Traffic Safety Administration says it will bring industry stakeholders, safety advocates and technical experts together to consider updates to FMVSS No. 108, the federal standard governing vehicle lighting. The agency described this as the beginning of a negotiated rulemaking, not a completed update. No new headlight limits, approved technologies or final technical criteria were announced.
NHTSA Administrator Jonathan Morrison said the process is intended to address potential causes of glare while enabling newer safety-related lighting technologies. The agency’s announcement describes subjects for examination, not decisions about what the revised standard will require. NHTSA’s October 6 announcement does not give a date for a final rule.
Five subjects the rulemaking will examine
1. Headlight glare
NHTSA plans to examine how modern headlighting technology affects glare for other road users and consider possible changes. The announcement does not define a new glare threshold or specify a technology that would be required or prohibited.

2. Lighting technologies
The agency lists LEDs, dusk sensors, automatic high beams and replaceable light sources among the technologies it wants the rules to address. Their inclusion means they are on the agenda; it does not mean NHTSA has approved a particular design or proposed a specific requirement.
3. Headlamp height and aim
NHTSA will evaluate how headlamp height and aim affect driver visibility. The announcement does not set a height limit, prescribe an aiming method or state what changes, if any, will follow.

4. Tests and materials
The agency plans to consider streamlining test procedures involving plastic optics and replaceable lenses. It has not described revised test protocols or material requirements.
5. International alignment
NHTSA will consider harmonizing U.S. vehicle-lighting regulations with international safety standards. The announcement does not name a preferred international regime or say that the United States will adopt another jurisdiction’s rules wholesale.

How stakeholders could participate
For this process, Transportation Secretary Sean P. Duffy was to appoint up to 18 committee members from vehicle-lighting manufacturers, motor vehicle equipment associations, safety organizations, research institutions and engineering associations. NHTSA also invited comments on the scope of the rulemaking and the balance of committee membership, along with formal nominations for membership.
The deadline stated in the October 6 announcement for comments and nominations was November 9, 2026. The notice identifies Docket No. NHTSA-2026-1981. The announcement does not describe a later final-rule schedule.

Why adaptive driving beams are part of the discussion
Road & Track reported that a 2022 update to FMVSS No. 108 was intended to allow adaptive driving beam technology, but used U.S.-specific requirements rather than simply adopting international standards. The publication said few manufacturers developed distinct systems for the U.S. market. That historical account comes from Road & Track’s October 6, 2026 report, not the NHTSA announcement itself.
The new process puts international alignment and newer lighting technologies on the list of subjects for discussion. It does not yet establish whether the rules for adaptive driving beams—or any other technology—will change.

What drivers should expect next
For drivers concerned about headlights that seem too bright, the immediate news is a regulatory review, not a change to the lights on vehicles already on the road. NHTSA has identified glare, visibility, lighting technology, testing and international alignment as areas for committee work. The agency has not announced adopted requirements or a final-rule date, so the practical effect on future vehicles remains undecided.
