New York City Council file T2026-2361 would prohibit operating class 3 e-bikes on city streets, in parks and in other public places. It is a pending proposal—not an enacted ban—and its safety and community effects remain unsettled. The Council record shows a hearing and layover on September 30, 2026.
What would New York City’s proposed e-bike law do?
Introduced by Council Members Crystal Hudson, Abreu and Wong, T2026-2361 is specifically an operation restriction on class 3 e-bikes in New York City public places. Its text does not establish that all e-bikes, e-scooters or e-motos would be covered. Nor does the available Council record provide a crash or injury evaluation showing that this restriction would improve safety.
Warnings first, then civil penalties
Before April 1, 2029, a person violating the proposed restriction would receive a warning and information rather than a notice of violation. Starting April 1, 2029, the text sets a $0 first civil penalty, up to $50 for a second violation on a different day within two years, and up to $100 for subsequent violations on different days within that period.
For a subsequent violation involving operation that endangered the rider or another person’s safety or property, the text would also allow the device to be impounded. The owner could face removal and storage charges as well as applicable penalties. The bill directs the commissioner to prepare information about safe operation, e-bike classifications and legality, possible trade-ins, conversion of class 3 bikes to class 1 or 2, and how to recover an impounded device.

Where the bill stands
The City Council’s file records a hearing and layover on September 30, 2026, and indicates that the measure was pending at that point. A hearing or layover is not enactment; the proposal should not be treated as current law.
Is it a safety measure—or a target on marginalized communities?
Those are important questions, but the available evidence does not establish either a safety benefit or discriminatory impact for this particular proposal. T2026-2361 defines a vehicle class and a restriction; its text is not proof that class 3 e-bikes cause a particular share of crashes, that banning their operation will prevent injuries, or that enforcement will fall disproportionately on a particular group.
The Council file, the NYC Comptroller’s 2024 micromobility report and the Mayor’s Office announcement on cyclist enforcement do not provide direct testimony from affected riders or a primary community-impact study of this bill. Without that evidence, it would be premature to call the proposal discriminatory—or to dismiss concerns about how it could affect workers and other riders.

What could matter for delivery workers and other riders
The practical impact would depend on details beyond the bill’s vehicle-class restriction: whether affected workers can obtain a compliant bike or convert their existing one, how enforcement works in practice, and whether a change would disrupt work or access to transportation. The bill directs the commissioner to prepare information on conversion and trade-ins, but the available text does not establish that affordable compliant options will be available or that a trade-in program will be provided.
The Comptroller’s 2024 report points to other parts of the safety problem. It recommended street-legal bikes and batteries, battery swaps, safer charging facilities, and charging locations convenient for delivery workers. The report said the then-existing Department of Transportation charging pilot had enrolled about 100 delivery workers; that is the report’s figure for the pilot at that time, not a current enrollment count.
In March 2026, the Mayor’s Office said the city would end criminal summonses for low-level cyclist and e-bike traffic violations and use civil summonses, while expanding delivery-worker training and developing legislation concerning app-company practices and trip-level data. The administration argued that unrealistic delivery times can incentivize dangerous riding. That is its stated position, not an independently established causal finding. These measures concern enforcement, training and platform conduct; they are distinct from T2026-2361’s proposed class 3 operation restriction.

How is this different from other New York e-bike proposals?
Several proposals discussed in New York concern different vehicles or regulate different conduct. They should not be treated as parts of this City Council bill.

In the Senate announcement about the e-moto proposal, NYC DOT Commissioner Mike Flynn said, “Two of the biggest factors of the severity of a traffic crash are the speed and weight of a vehicle, which is why the proliferation of faster, heavier illegal e-mobility devices is such an alarming trend on our streets.” His statement concerns faster, heavier illegal devices; it does not establish that class 3 e-bikes are the same vehicles or that this Council bill would address the same problem.
What evidence would help answer whether the proposal works fairly?
A meaningful assessment would need to examine both safety outcomes and who bears the costs. The available policy records describe proposals and recommendations, but do not compare measured outcomes to show which approach works best.
- Safety outcomes: Track crashes and injuries involving the vehicles covered by the bill, rather than assuming the restriction will reduce them.
- Enforcement: Examine who receives warnings, civil penalties or impoundment, and whether enforcement differs by neighborhood or rider group.
- Access and cost: Determine whether compliant bikes, conversion options or trade-ins are actually available and affordable to people whose vehicles would be affected.
- Alternatives and complements: Assess street design, safer equipment and batteries, charging access, worker training and delivery-app practices alongside restrictions on riders.
- Rider perspectives: Hear directly from delivery workers and other affected riders about safety risks, work requirements and likely effects on their transportation options.
That evidence would help distinguish the proposal’s stated mechanism—a restriction on one vehicle class—from its real-world effects. Until those outcomes and impacts are established, neither a safety success nor a discriminatory result can be presented as settled.
