New York has not banned electric dirt bike sales. Senate bill S10700, introduced September 14, 2026, is a pending proposal in the Senate Rules Committee. If enacted, it would ban retail sales of vehicles meeting its definition of an “e-moto,” restrict sales of electric off-highway motorcycles to registered New York ATV dealers, and require warnings and truthful marketing. Can you still buy an electric dirt bike in New York?
As of the bill record’s latest status, S10700 is a proposal, not a law in effect. Its proposed restrictions would apply only if the bill is enacted. The Senate record lists the bill as active and referred to the Rules Committee on September 14, 2026. The sponsor’s memo says the act would take effect immediately if enacted. Whether a particular vehicle would fall under the proposal depends on its legal classification—not simply whether a seller calls it an “electric dirt bike.” S10700 addresses two categories separately: “e-motos” and electric off-highway motorcycles.
What S10700 would change
It would prohibit retail sales of covered e-motos
The bill would prohibit a person or business operating as an online retailer or at a physical retail location in New York from selling, offering for retail sale, or reselling an e-moto in the state. The prohibition expressly reaches internet retail. [New York State Senate bill text]

The proposed definition covers a device equipped with a motor capable of propelling it above 20 mph, but it also excludes devices outside the motor-vehicle definition in section 125 of the Vehicle and Traffic Law and devices eligible for registration under that law. Those cross-references mean the speed threshold alone does not determine whether a vehicle is an e-moto under the bill. [New York State Senate bill text]
It would channel electric off-highway motorcycle sales through registered ATV dealers
The proposal defines an electric off-highway motorcycle as an off-highway motorcycle under state law that is propelled by an electric motor and eligible for registration under the Vehicle and Traffic Law. The definition applies whether or not the vehicle has pedals.
If enacted, these motorcycles could be sold only by an all-terrain vehicle dealer physically located in New York and registered with the DMV. Online retailers could not sell or resell them under the proposal, and the dealer would have to register each covered motorcycle before delivering it to the buyer. It would require warnings and restrict misleading labels
Where a covered device is sold, displayed, or delivered—including online or at a physical point of sale—the bill would require a conspicuous warning before a buyer attempts to purchase it. The proposed warning must be bold and the same font size as the purchase price. Its text is:

“WARNING: IT IS NOT LEGAL TO RIDE THIS DEVICE ON ANY PUBLIC HIGHWAY OR STREET UNDER NEW YORK STATE LAW. IT IS NOT LEGAL TO SELL THIS DEVICE TO A PURCHASER IN NEW YORK STATE. VIOLATIONS OF THE LAW MAY RESULT IN A CIVIL PENALTY.”
This is language in the proposed bill, not a warning requirement currently imposed by S10700. The proposal would also make false, deceptive, or misleading marketing unlawful and bar representing a covered e-moto or electric off-highway motorcycle as an e-bike, e-scooter, or off-highway motorcycle unless it meets that category’s applicable legal definition. How an e-moto differs from a New York e-bike
New York’s existing e-bike guidance describes a different classification system. The state Attorney General says e-bikes must have motors under 750 watts and fit one of these three classes:

| Class 2 | Motor assistance up to 20 mph; a throttle may operate without pedaling |
| Class 3 | Assistance stops at 25 mph |
E-bikes sold in New York must have a permanent label identifying the class, assisted speed, and motor wattage. The Attorney General’s guidance also covers age rules and notes that local governments may add restrictions. Vehicles that exceed the applicable e-bike speed limits may instead be classified as e-motos, mopeds, or motorcycles and may trigger additional registration, licensing, or insurance requirements. A dirt-style frame, pedals, or a seller’s product label is not enough on its own to establish the vehicle’s legal category. The relevant definitions, speed and motor characteristics, and registration eligibility all matter; the bill’s e-moto definition also includes statutory exclusions.

Proposed enforcement and penalties
S10700 would authorize the Attorney General and certain municipal officials to pursue enforcement. For violations of the sales provisions, the bill provides for injunctions and, where appropriate, restitution, with a civil penalty of up to $1,000 per violation. It also allows potential relief from that penalty under specified conditions involving a first proceeding and corrective measures.
- Failure to provide the required warning: up to $250 for a first offense and up to $1,000 for each later offense.
- Deceptive marketing: up to $500 per violation, or up to $1,000 if a court finds the violation was knowing.
These are proposed penalties; they would not apply under S10700 unless the bill becomes law. [New York State Senate bill text]
