Will EU tariffs make Chinese electric cars more expensive? They can raise the cost of importing covered battery-electric vehicles (BEVs) originating in China, but the duty rate is not a forecast of how much a buyer will pay. The European Union’s countervailing duties are charged in addition to the ordinary 10% import duty on BEVs. A qualifying price undertaking can instead require an exporter to meet a minimum import price and other conditions, with countervailing duties not imposed on covered sales. Neither mechanism alone tells you what a particular car will cost at a dealership.
Which cars are covered by the EU measure?
The measure discussed here is the EU’s countervailing duty on covered Chinese-origin battery-electric vehicles—not a tariff on every car made in China, every vehicle type, or every car associated with a Chinese company. Whether a particular vehicle falls within the measure depends on the applicable product scope and origin rules, as well as the relevant exporter classification. The European Commission’s public announcements provide a summary; the regulation published in the Official Journal is the legally binding reference for precise scope and customs treatment.

“Made in China” is therefore not enough information to determine the duty on a vehicle. Nor does a brand name by itself establish the applicable rate. A buyer comparing cars should distinguish the vehicle’s origin, whether it is within the covered BEV product scope, and the exporter category that customs treatment uses. For a specific import or model, the applicable legal measure—not a general headline about tariffs—controls.

What are the definitive countervailing duty rates?
The European Commission announced the following definitive additional rates on 29 October 2024. These are countervailing-duty rates by exporter category, not retail-price increases. They should not be confused with earlier provisional rates announced during 2024.

| Exporter or category | Definitive countervailing duty |
|---|---|
| BYD | 17.0% |
| Geely | 18.8% |
| SAIC | 35.3% |
| Other cooperating companies | 20.7% |
| Tesla, following an individual examination request | 7.8% |
| Other non-cooperating companies | 35.3% |
The applicable rate turns on the exporter’s classification and the legal measure in force. These figures describe the definitive rates announced by the Commission, not a universal rate for Chinese-made cars. If a model’s exporter category or legal status is unclear, do not infer its rate from another vehicle or manufacturer.
How do the countervailing duty and ordinary import duty interact?
The Commission’s August 2024 Q&A says the countervailing duties are added on top of the ordinary 10% import duty on BEVs. Those are two separate border-duty measures. The 10% figure is the ordinary import duty; the company-specific percentages in the table are additional countervailing rates.
That distinction matters because adding statutory duty rates is not the same as calculating a car’s final price. The percentages describe import duties, not a measured change in an advertised or transaction price. The Commission’s announcement supplies rates, but it does not establish how the relevant amounts are calculated for an individual car or how they move through a particular company’s pricing. A precise customs calculation requires the applicable legal rules and import details.

If a countervailing duty is payable on an imported vehicle, it raises the importer’s border cost. That creates a potential source of upward pressure on the vehicle’s costs in the EU market. It does not dictate whether, when, or how much a manufacturer, importer, or dealer changes the price a customer sees.

Companies may make different decisions about how to respond to a cost. A cost might be reflected in a higher price, absorbed in an exporter’s or importer’s margin, or offset by a commercial discount. The available Commission evidence does not quantify what share is passed through to consumers, absorbed, or offset. It also does not provide a before-and-after retail-price statistic for EU buyers. As a result, claims that a particular car has become more expensive by the duty rate—or by the duty rate plus 10%—cannot be established from these rates alone.
To assess a claim about a real price change, compare the same model and specification in the same market at dated points, and establish whether the consumer-facing figure is an advertised price or a transaction price. Then separate any change in import costs from other price decisions. Without that kind of evidence, the duty provides a possible cost mechanism, not proof of a showroom increase.
What is a price undertaking?
A price undertaking is an exporter’s commitment to sell covered products above a minimum import price under terms accepted by the Commission. For qualifying sales covered by the undertaking, the Commission does not impose the countervailing duty. The arrangement is an alternative form of trade measure, not a general waiver for a brand or for all vehicles made in China.

It also says import prices and volumes are monitored. The precise terms of an accepted undertaking determine which products and sales qualify.

For consumers, the practical distinction is that a duty arrangement imposes a border charge on covered imports, while an undertaking substitutes a price floor and associated obligations for that charge on qualifying covered sales. It does not promise that the retail price will fall, remain unchanged, or match the minimum import price: the latter is part of the undertaking’s import terms, not a quoted consumer price.
What does the CUPRA Tavascan undertaking cover?
On 10 February 2026, the Commission announced that it had accepted an undertaking from Volkswagen (Anhui) Automotive Company Ltd. and related EU party SEAT S.A. for the CUPRA Tavascan. Under the arrangement, the model may be exported into the EU at or above its proposed minimum import price and be exempt from countervailing duties on qualifying sales covered by the undertaking.
The Commission also described import-volume limits and BEV-related EU investment commitments with milestones as terms of the arrangement. It said its investigation found that the price floor for this specific model would not be injurious to EU industry. The decision is a specific model-and-exporter arrangement. It does not establish an exemption for other Volkswagen-group vehicles, other exporters, or Chinese-origin imports generally.

How are undertakings assessed and enforced?
In January 2026, the Commission issued BEV-specific guidance on price-undertaking offers. Its public announcement identifies minimum import price, sales channels, cross-compensation, and future EU investment as issues addressed in a possible offer. The Commission says it assesses each offer against the same legal criteria, objectively, without discrimination, and in accordance with World Trade Organization rules. The presence of any one element does not by itself establish that an offer will be accepted.
An undertaking is conditional, not an automatic entitlement. The Commission’s general framework says the exporter must meet the accepted terms and that imports are monitored. The Commission’s undertaking announcement further states that non-compliance can lead to withdrawal and retroactive reinstatement of duties. For a buyer or importer, this means an undertaking’s existence should not be treated as a permanent or unconditional exemption; its scope and status matter.

The Commission announced that the definitive measures were imposed for five years. Its October 2024 announcement said they would take effect after publication in the Official Journal; it also said the provisional duties imposed in July 2024 would not be collected. The Commission described monitoring the measures for effectiveness and circumvention.

Five years is the announced measure period, not a guarantee that the rules cannot be reviewed or change during that time. The Commission’s anti-subsidy framework describes a five-year period subject to interim review and possible extension following an expiry review. Rates, product scope, exporter status, review outcomes, and accepted undertakings are all details that can affect the treatment applicable at a later date. For a current purchase or import decision, check the legal status in force at that time.

How to assess a price claim about a specific car
When a news report or seller says a Chinese-made electric car is affected by EU tariffs, work through the factors that determine whether that statement applies to the model and the consumer price being discussed.
- Identify the vehicle and origin. Confirm that the car is a BEV within the relevant covered product scope and that the origin rules make the measure applicable. A model’s brand or assembly location alone may not resolve every legal question.
- Identify the exporter category and measure. Establish which definitive rate applies to the exporter, or whether a Commission-accepted undertaking covers the exporter, product, and sale. Do not substitute another company’s rate.
- Separate border duties from the consumer figure. The ordinary import duty and any countervailing duty concern import costs. A listed showroom price is a different price stage, and the duty percentage does not measure its change.
- Check the date and market. The relevant duty, undertaking, and price comparison must apply to the same period and EU country. A price in one country or at one date does not establish the effect elsewhere.
- Look for actual price evidence. A defensible pass-through claim needs dated, comparable retail or transaction prices and a way to distinguish the tariff’s contribution from other commercial pricing choices. The Commission’s duty rates alone do not supply that evidence.
What the Commission’s figures establish—and what they do not
The Commission’s published rates establish the definitive countervailing-duty percentages announced for the named exporters and categories. Its Q&A establishes that those countervailing duties sit on top of the ordinary 10% import duty on BEVs. The Commission’s undertaking announcements establish that accepted price-floor arrangements can exempt qualifying covered sales from countervailing duties, subject to their terms.
Those facts do not establish the price of a particular car after duties, the amount any company has passed through, or a percentage change in what consumers pay. Nor does the Tavascan decision establish the terms available to another model. For legal classification, customs calculations, or a current model-specific status, the relevant Official Journal regulation and applicable undertaking terms are more authoritative than a broad summary.
