How China is regulating robotaxis is best understood as a layered, permission-based system, not one national robotaxi law. National ministries set the framework for road tests, product access, transport safety, insurance, data, mapping, recalls, software updates and standards, while cities decide where vehicles may operate, which assessments they need and whether safety supervision can move off board.
China therefore permits driverless taxi operations in specified areas without creating unrestricted nationwide taxi rights. The framework below reflects the official rules and releases available through August 13, 2026; local operating zones, permits and safety conditions can change.

Key takeaways
- China does not regulate robotaxis through one comprehensive national robotaxi act; national ministries set the framework while cities control practical deployment.
- Autonomous vehicles providing taxi services must generally operate in designated areas and pass the applicable road-traffic safety assessment.
- Conditional and highly automated taxis generally require one onboard safety operator, while fully automated taxis may use remote safety operators only under defined local conditions.
- The national transport guidance sets a remote safety-operator ratio of no lower than one person for three vehicles when remote supervision is permitted.
- Robotaxi regulation covers transport qualifications, insurance, monitoring, emergency response, maintenance, product access, recalls, OTA software updates, cybersecurity, personal information, mapping and geospatial data.
What does “legal” mean for a robotaxi in China?
Robotaxis are legal on Chinese public roads only within an authorization framework that depends on the vehicle, operating entity, development stage, city, road area and safety controls. China permits autonomous taxi operations in specified areas, but national rules do not give every robotaxi company a nationwide right to offer ordinary, unrestricted taxi service.

The central rule is found in the Ministry of Transport’s 2023 trial guidance on autonomous-vehicle transport safety services. The guidance covers autonomous vehicles used for public buses, taxi passenger transport, road passenger transport and road freight on roads open to social motor vehicles. The guidance describes a controlled model based on legality, safety first, orderly progress and controlled innovation.
#1 Best Overall
The guidance states: “自动驾驶汽车开展道路运输服务应在指定区域内进行,并依法通过道路交通安全评估。” The Ministry of Transport’s 2023 trial guidance translates this principle as: “Autonomous vehicles providing road-transport services should operate in designated areas and pass a road-traffic safety assessment.” The document is trial guidance, not a single comprehensive statute replacing all road-traffic, product, transport, data and local rules.
That distinction explains why two statements can both be true: China allows fully automated taxi operations in approved locations, and a particular robotaxi operator may still be unable to carry ordinary paying passengers in a different city or on a different road.
How is China’s national robotaxi regulatory framework organized?
China’s national framework is a stack of rules and administrative systems rather than one robotaxi law. The stack begins with road testing, adds product access and road-operation pilots, and then connects transport safety, vehicle registration, insurance, data governance, mapping, recalls, software updates and technical standards.
| National layer | Primary purpose | Practical consequence for a robotaxi operator |
|---|---|---|
| Road testing and demonstration applications | Sets the baseline for intelligent-connected-vehicle testing and demonstration on real roads. | A test or demonstration authorization is controlled and location-specific; it is not blanket permission for unrestricted taxi service. |
| Product access and road-operation pilot | Creates a route for intelligent-connected vehicles seeking product access and permission to operate on roads. | The vehicle and manufacturer must satisfy product-level requirements in addition to the operator’s local transport and safety requirements. |
| Autonomous-transport safety | Governs passenger and freight services, designated operating areas, safety assessment, safety personnel, monitoring and emergency response. | A company must demonstrate service-level controls, not merely show that its automated-driving system can drive. |
| Product access, recalls and OTA updates | Places responsibility on manufacturers for connected-vehicle capabilities, automated-driving failures, collisions, recalls and software upgrades. | A software change or safety incident can trigger manufacturer reporting, validation or recall duties. |
| Data, cybersecurity and mapping | Regulates personal information, important data, geospatial information, cross-border transfers and surveying-and-mapping activity. | A robotaxi fleet must treat its sensor data and remote-operations systems as part of the compliance perimeter. |
| Vehicle registration and technical standards | Determines how authorized vehicles are documented and defines technical or operational expectations. | Registration, a technical standard and permission to carry passengers are separate legal questions. |
The 2021 national road-testing and demonstration framework, issued by the Ministry of Industry and Information Technology, the Ministry of Public Security and the Ministry of Transport, is the starting point for controlled public-road testing. The later national pilot implementation guide for intelligent-connected-vehicle product access and road operation supplements that framework for vehicles seeking a path toward broader product access and road use.
The system therefore regulates two things at once. It regulates the robotaxi as a transport service carrying passengers, and it regulates the robotaxi as a safety-critical connected vehicle whose hardware, software, data and manufacturer remain subject to product rules.
What are the four stages of robotaxi deployment in China?
Testing, demonstration application, road-application pilot and commercial transport operation are different stages. Authorization at one stage or in one area does not automatically authorize the next stage or a different city.
| Stage | What the stage generally means | What the authorization does not prove |
|---|---|---|
| Road testing | Controlled evaluation of an intelligent-connected vehicle on approved public roads under the applicable testing framework. | It does not by itself establish a general right to charge passengers as a taxi. |
| Demonstration application | A supervised real-world demonstration in an approved place and under specified conditions. | It does not necessarily authorize ordinary commercial transport or operation outside the approved area. |
| Road-application pilot | A more advanced local pathway for putting an authorized vehicle into defined road use, often with operational monitoring, inspections and safety assessment. | It does not create nationwide approval or eliminate local operating conditions. |
| Commercial transport operation | Passenger or freight service conducted under transport qualifications, insurance, safety management, monitoring and local authorization. | It does not mean that every vehicle in the company’s fleet, or every road in the city, is approved. |
Readers should ask which stage a headline describes. “Robotaxis are testing in a city,” “a vehicle is in a road-operation pilot” and “a company may provide paid taxi service” are not interchangeable statements.
What permissions and safeguards does a robotaxi company need?
There is no single nationally uniform application packet that answers every city’s requirements. A company moving from testing toward passenger service should expect to address the following layers, with the exact documents and approval route determined by the vehicle, city and operating area.
- Legal operating entity: The operator must be legally registered and hold the relevant transport-business qualifications for the service it provides.
- Vehicle and product status: The vehicle may need a testing, demonstration, product-access or road-operation status, depending on its stage. Product access is separate from the company’s transport qualification.
- Local operating area: The operator needs authorization for designated roads, districts or operating zones. A permit for one area does not automatically cover another.
- Road-traffic safety assessment: Autonomous transport service must pass the applicable safety assessment before operating in the authorized area.
- Human-supervision plan: The company must identify whether the vehicle carries an onboard safety operator or uses remote safety operators under the conditions allowed by the local government.
- Insurance or liability guarantee: The operator must obtain compulsory traffic insurance and carrier-liability insurance, or provide an acceptable liability guarantee under the transport rules.
- Monitoring and emergency response: The company must maintain operational monitoring, emergency procedures, network-security controls, safety management and incident-reporting systems.
- Vehicle maintenance and inspection: Key vehicle systems and automated-driving functions must be maintained and checked under applicable national and local rules.
- Data and mapping compliance: The company must assess personal information, important data, geospatial information, mapping qualifications, storage and any cross-border transfer.
- Manufacturer controls: The manufacturer must address recalls, automated-driving failures, collisions, technical validation and OTA software upgrades.
The Ministry of Transport guidance specifically requires operating entities to establish safety-management systems, monitoring systems, emergency-response systems, network-security systems and training systems. Safety personnel must receive technical and transport-business training, understand the operating routes and be capable of emergency intervention.
Do Chinese robotaxis still need a safety driver?
Often yes, but the answer depends on the vehicle’s automation category and the local authorization. China’s transport guidance generally requires one onboard safety operator for conditional and highly automated taxi operations. A fully automated taxi may use remote safety operators only when the relevant conditions are satisfied.
| Vehicle or operating situation | Supervision rule in the national transport guidance | Important limitation |
|---|---|---|
| Conditional automated taxi | One safety operator should be onboard. | The rule concerns the transport-service framework; it does not authorize every vehicle or route. |
| Highly automated taxi | One safety operator should be onboard. | Local approval and the vehicle’s authorized operating conditions still apply. |
| Fully automated taxi | A remote safety operator may be used when safety is assured, the city-level government agrees and the vehicle operates in a designated area. | Remote supervision is permitted only under defined conditions; it is not an automatic national entitlement. |
| Remote supervision ratio | The ratio may not be lower than one remote safety operator to three vehicles. | The 1:3 condition does not prove that every Chinese city permits driverless passenger service. |
The guidance’s exact wording is: “远端安全员人车比不得低于1:3。” In English, the Ministry of Transport’s 2023 trial guidance says that “the remote safety-operator ratio may not be lower than one person to three vehicles.” The ratio is a condition within the trial transport framework, not a universal fleet formula that overrides city-level approval.

A national standards project addresses skills, training and assessment for remote safety inspectors of commercial automated-driving vehicles. The project is evidence that the operational rulebook for remote personnel is still being developed; it should not be described as a final effective national standard. The official standards registry entry for the remote-safety-operator skills project identifies its standards-project status.
Can driverless taxis operate on Chinese public roads?
Yes, driverless taxis can operate on Chinese public roads in designated and authorized areas, but “driverless” does not mean unregulated or unrestricted. The operating entity still needs the applicable local approval, safety assessment, monitoring, emergency-response capability, insurance and safety-supervision arrangement.
The legal distinction is between the absence of an onboard driver and the absence of human responsibility. A fully automated taxi may be permitted to use remote safety personnel, while the operator remains responsible for maintaining communications, monitoring, emergency procedures and trained intervention capability.
Local authorities may also impose safeguards beyond the national trial guidance. Those safeguards can determine the approved operating zone, hours, weather conditions, vehicle inspection schedule, remote-monitoring setup, passenger-service limitations and process for responding to incidents.
Who is responsible if a robotaxi crashes in China?
China’s reviewed framework does not settle every robotaxi-crash question through one dedicated national liability statute. The outcome can depend on the vehicle’s legal status, the operating arrangement, the facts of the crash, applicable traffic law, the city’s implementation rules and whether the issue concerns the operator, manufacturer, safety personnel or another party.
| Party | Established regulatory responsibility | What cannot be assumed |
|---|---|---|
| Transport operator | Business qualifications, insurance, monitoring, emergency response, safety management, training, maintenance and serious-incident reporting. | Insurance requirements alone do not answer every final civil-liability question. |
| Vehicle manufacturer | Product access, technical capabilities, recall procedures, OTA controls, automated-driving failure reporting and collision reporting. | A manufacturer duty does not automatically establish the outcome of every lawsuit or crash claim. |
| Onboard or remote safety personnel | Training, route knowledge and the ability to intervene or respond to emergencies within the authorized operating model. | The existence of a safety operator does not make that person the sole liable party. |
| Local authorities | Designated areas, assessments, registration or operating approvals, monitoring expectations and enforcement. | Local authorization does not transfer all operational responsibility from the company to the government. |
The transport guidance requires compulsory traffic insurance and carrier-liability insurance, or an acceptable liability guarantee. Beijing’s local regulation also requires compulsory motor-vehicle insurance, carrier-liability insurance and other supplemental commercial insurance for road-test, demonstration and road-application-pilot participants under national and local rules.
The practical answer to “who is liable?” is therefore not simply “the algorithm” or “the passenger.” Investigators and courts would need to examine the approved operating status, the company’s duties, the vehicle’s product status, the human-supervision arrangement, maintenance and software history, the crash facts and the applicable local and national law.
How do recalls and OTA software updates fit into robotaxi regulation?
Robotaxi regulation reaches beyond the road because an automated-driving function can change through software. China’s 2025 notice on intelligent-connected-vehicle product access, recalls and software online upgrades requires manufacturers to build capabilities for connected-vehicle products and OTA activities, submit technical parameters and validation materials for already approved products and report specified automated-driving failures and collisions.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →The notice also requires automated-driving OTA upgrades to follow relevant product-access rules. That means an operator cannot treat a material change to the driving system as merely a routine app update with no regulatory significance.
The State Administration for Market Regulation later described a policy direction of stronger coordination among product access, recalls, certification, accident reporting and safety-data analysis, alongside work to improve accident-investigation and traceability rules. The 2025 SAMR notice on product access, recalls and OTA upgrades is the key source for the manufacturer-side obligations.
How does China regulate robotaxi data and mapping?
China treats robotaxi data as a regulatory issue because the vehicles collect location information, imagery, point clouds, road features and other environmental data. The compliance question is not simply whether the car can drive; it is also what data the fleet collects, who processes it, where it is stored, whether it qualifies as important data and whether it crosses China’s borders.
Beijing’s autonomous-vehicle regulation says entities using autonomous vehicles for mapping must hold the relevant surveying-and-mapping qualification or work through a qualified entity. The regulation also requires measures to protect geographic-information data transmitted outside the vehicle for storage or processing.

National policy is expanding beyond domestic collection and storage. The 2026 automotive-data cross-border security guidance covers research and development, manufacturing, automated driving, software upgrades, connected operation, important data, personal information and geospatial data. Depending on the data and activity, cross-border processing may require a security assessment, standard contract or personal-information certification. Some categories may qualify for exemptions.
The accurate conclusion is not that all robotaxi data must remain in China. The accurate conclusion is that cross-border transfers are governed by data-security, personal-information, important-data and mapping or geospatial rules, and the required compliance route depends on the data and the activity.
How does Beijing turn national policy into operating permission?
Beijing shows how a municipality converts the national framework into local statutory governance. Beijing’s Autonomous Vehicle Regulation was adopted on December 31, 2024, and took effect on April 1, 2025. The regulation covers technology innovation, infrastructure, road testing, demonstration applications and road-application pilots in the municipality.
The Beijing Autonomous Vehicle Regulation creates a legal basis beyond temporary testing permits, with provisions addressing technical innovation, infrastructure, road access, safety and legal responsibility. Road-application-pilot entities must maintain operational-monitoring platforms capable of monitoring vehicles, personnel, networks and operations, and must support access to relevant vehicle-operation and incident data.

The Beijing trial method for autonomous-vehicle safety assessment illustrates the local approval process: a company must demonstrate capability and emergency readiness in addition to presenting a functioning automated-driving system.
The Beijing implementation materials also establish recurring attention to key vehicle systems and automated-driving functions, as well as enforcement for failures such as unauthorized road application, inadequate maintenance or failure to provide qualified safety personnel. Beijing therefore demonstrates the central pattern: national policy creates the framework, while municipal rules determine the practical evidence, monitoring and enforcement needed for operation.
Which Chinese cities allow robotaxis?
Beijing and Shenzhen are two clear examples in the reviewed official materials, but they should not be treated as an exhaustive list of Chinese cities with robotaxi service. City permissions, operating zones and service conditions can change, and a city’s vehicle-registration rules do not necessarily authorize paid taxi operations.
| City | What the official local rule shows | What it does not establish by itself |
|---|---|---|
| Beijing | A municipal regulation effective April 1, 2025 covers road testing, demonstration applications and road-application pilots, with local safety assessment, monitoring, insurance and enforcement requirements. | The regulation does not mean every robotaxi company can operate throughout Beijing without a designated area or assessment. |
| Shenzhen | The February 14, 2026 intelligent-connected-vehicle registration rules address vehicles with automated-driving functions meeting national Level 3 conditional-automation or Level 4 high-automation definitions, when the vehicles are included in the relevant national catalogue or Shenzhen product list and used within Shenzhen. | Registration is vehicle-status governance; registration alone is not proof of permission to provide paid passenger transport on every Shenzhen road. |
The Shenzhen intelligent-connected-vehicle registration rules are important because they show a layer often missed in simplified coverage: road testing and passenger-service permission are not the same as ordinary vehicle registration.
Which Chinese standards matter for automated driving?
Technical standards are developing alongside operating rules, and each standard must be matched to the automation function it actually covers.
GB/T 45312-2025, “Intelligent and connected vehicles—Operational design condition for automated driving system,” is an effective national standard issued under the authority of the Ministry of Industry and Information Technology. Its subject is the operational design condition: where and under what conditions an automated-driving system is designed to function. That concept is directly relevant to designated roads, weather, traffic environments and other limits on robotaxi operation.
China also published a mandatory national standard for combined driver-assistance-system safety in 2026, scheduled to take effect on January 1, 2027. The standard concerns driver-assistance systems in which the human driver remains responsible for observing traffic and controlling the vehicle. The Ministry of Industry and Information Technology’s 2026 announcement should not be presented as the final national Level 4 robotaxi rule.
According to the Ministry of Industry and Information Technology in 2026, combined driver-assistance functions had a reported 70% penetration among new passenger cars since the beginning of 2026, while navigation-assisted driving, or NOA, appeared in more than 30% of new passenger-car models during that period. Those figures concern driver-assistance vehicles, not Level 4 robotaxis, and cannot be used as evidence that China has commercially deployed a particular number of robotaxis.

China has also participated in developing a global automated-driving technical regulation through the UNECE vehicle-regulation process. The Chinese government’s account of the global technical regulation and the UNECE announcement show international technical cooperation, but an international technical regulation and Chinese permission to operate a robotaxi in a particular city remain separate questions.
Is China ahead of the United States on robotaxi regulation?
The reviewed authorities do not support a simple yes-or-no ranking of China against the United States. China’s model is clear in one respect: national ministries establish a broad framework, and municipal authorities convert that framework into designated operating areas, assessments, registration, monitoring and enforcement.
A defensible comparison must compare equivalent deployment stages and not mistake a public-road test, a demonstration, a road-application pilot or a paid taxi service for the same thing.
| Comparison axis | What China’s reviewed framework shows | Question required for a fair international comparison |
|---|---|---|
| Regulatory level | National product, transport, data and standards rules are combined with city-level implementation. | Are the other country’s rules national, state or municipal, and which authority issues the operating permission? |
| Deployment stage | Testing, demonstration, road-application pilot and commercial transport are distinct. | Are the compared services actually carrying paying passengers, or are they still testing? |
| Human supervision | Onboard safety operators generally apply to conditional and highly automated taxis; remote supervision for fully automated taxis requires specified conditions. | Does the comparison concern onboard supervision, remote supervision or no human supervision? |
| Geographic scope | Operation is normally confined to designated areas and approved roads. | How large is the authorized zone, and can the vehicle operate beyond it? |
| Vehicle authorization | Product access, registration, testing status and transport authorization are separate layers. | Does the other system separately regulate the vehicle, operator and passenger service? |
| Data governance | Personal information, important data, geospatial information, mapping qualifications and cross-border transfers matter. | Are the same categories of sensor, mapping and passenger data being compared? |
| Responsibility and insurance | Compulsory traffic insurance, carrier liability, monitoring, emergency response and reporting duties are established, while every civil-liability allocation is not summarized in one robotaxi statute. | Does the comparison distinguish insurance and operating duties from final civil liability? |
Without matching those variables, claims that one country is simply “ahead” can compare a tightly bounded commercial service with a broader testing program or compare driver-assistance adoption with Level 4 robotaxi deployment.

|---|---|
| Commercial autonomous transport is subject to designated-area and safety-assessment conditions. | The exact route from testing to paid passenger service differs by city. |
| Operators need legal business status, relevant transport qualifications, insurance, monitoring, emergency procedures and safety-management systems. | The size and boundaries of authorized operating zones can change. |
| Conditional and highly automated taxi operations generally require onboard safety personnel. | Whether a particular operator may remove the onboard safety operator depends on the city, vehicle, permit, area and current authorization. |
| Fully automated taxi operations may use remote safety personnel only under specified local conditions. | National accident-liability allocation is not summarized by one dedicated robotaxi statute in the reviewed sources. |
| Product access, recalls, OTA updates, incident reporting, cybersecurity, data protection and mapping can all be regulatory issues. | Mandatory standards for higher-level automated-driving systems continue to develop. |
| Municipalities may impose requirements higher than the national trial guidance. | National statistics for paid robotaxi rides, commercial fleets and total service kilometers require separate verification and should not be inferred from company claims. |
Frequently Asked Questions
Are robotaxis legal in China?
Yes, but only in authorized conditions. China permits autonomous taxi operations on public roads in designated areas after the applicable road-traffic safety assessment and local approval. A testing or demonstration permit does not automatically authorize paid taxi service nationwide.
Do Chinese robotaxis still need a safety driver?
Not always. Conditional and highly automated taxis generally require one onboard safety operator. Fully automated taxis may use remote safety operators only when safety is assured, the city-level government agrees and the vehicle operates in a designated area; the national trial guidance sets a minimum ratio of one remote operator to three vehicles.
Who is liable if a robotaxi crashes in China?
China’s reviewed rules establish compulsory traffic insurance, carrier-liability insurance or an acceptable liability guarantee, plus operator and manufacturer duties. The final civil-liability outcome is not fixed by one national robotaxi statute and depends on the vehicle status, operating arrangement, crash facts, traffic law and local implementation.
Does China require all robotaxi data to remain in China?
No. China does not impose one simple rule that all robotaxi data must stay in China. Cross-border transfers depend on data-security, personal-information, important-data, geospatial and mapping rules, with different compliance routes for different data and activities.
The Bottom Line
Bottom line: China regulates robotaxis through national rules plus city-level permission. A robotaxi may drive without an onboard driver only when its vehicle status, operating entity, designated area, safety assessment, remote or onboard supervision, insurance, monitoring, data controls and local authorization all line up. Beijing and Shenzhen show why a national policy announcement is not the same as a nationwide commercial taxi license.
