Yes. Volkswagen says it was indicted in Paris in February 2026 over EA 189 vehicles, while separate consumer and public-interest proceedings continue on different legal tracks. A May 2026 appeal ruling addressed one dispute, but it did not decide the CLCV group action or establish that every owner is entitled to compensation.
Which Dieselgate cases are under way in France?
“France is going after VW” describes several distinct actions, not one case with one outcome. The parties, defendants, legal questions and stages differ:

The vehicle populations also should not be conflated. Volkswagen describes the CLCV action as potentially covering up to one million French owners and lessees of EA 189 vehicles; that is the company’s estimate of the action’s possible scope, not the number of people enrolled. CLCV describes the vehicles in the Pau appeal decision as nearly 950,000 vehicles marketed between 2007 and 2015. Those figures refer to different descriptions of separate proceedings.
What did the Pau Court of Appeal decide?
In its 5 May 2026 account of the ruling, CLCV says the Pau Court of Appeal found Volkswagen Group France and Volkswagen Bank had breached the obligation to deliver goods conforming to the contract when marketing nearly 950,000 vehicles between 2007 and 2015. CLCV characterizes the decision as recognizing harm to the collective consumer interest.

That is CLCV’s description of the ruling. The association expressly states that the appeal decision does not settle the merits or outcome of its separate group action. The available account also does not establish a result for every vehicle owner, a general compensation amount, or a later appeal outcome.
Can a Volkswagen diesel owner still claim compensation?
The CLCV action is opt-in: it is not a payment automatically awarded to every French owner or lessee of an EA 189 vehicle. Volkswagen’s annual report describes the remedies CLCV sought as primarily rescission without compensation for use or, alternatively, damages of 20–30% of the purchase price. Those are the remedies as described by Volkswagen, not compensation already awarded or guaranteed to participants.

Anyone considering joining should check CLCV’s current information directly. The sources summarized here do not establish current enrollment requirements, a deadline, a participation form or an expected individual payment, so none should be inferred from the potential one-million-person scope.
What the limitation ruling does—and does not—mean
On 24 September 2025, the Cour de cassation stated: “cette prescription de cinq ans court à compter du jour où l’acquéreur a eu connaissance ou aurait dû avoir connaissance du défaut de conformité du bien qu’il a acheté.” In English: “this five-year limitation period runs from the day on which the buyer knew or should have known of the lack of conformity of the item purchased.”

This was a clarification in an individual conformity case. It does not, by itself, guarantee that another buyer’s claim is timely: the relevant knowledge date and other facts may differ. An owner assessing an individual claim should review purchase or lease records and correspondence with a qualified legal adviser.
What had EU authorities already concluded?
In September 2021, consumer-protection authorities in the EU Consumer Protection Cooperation network, coordinated by the European Commission, concluded that Volkswagen’s marketing of diesel cars fitted with illegal exhaust manipulation systems violated EU consumer-protection law. The Commission’s account also records Volkswagen’s position that it did not consider voluntary payments to consumers outside Germany justified. That EU consumer-law conclusion is distinct from the French criminal proceeding and the CLCV actions.

The European Commission reported in 2018 that 8.5 million cars had been recalled in the EU and that an 80% repair rate had been reached. Those are historical figures reported in 2018, not a current recall or repair rate.

In September 2025, CLCV, France Nature Environnement and ClientEarth announced legal action over the French state’s response to the emissions scandal. The National Consumer Institute’s report reproduces the organizations’ claim that affected vehicles emitted nitrogen oxides at two to ten times the applicable standards. That is an attributed allegation from the organizations, not an independently verified measurement established here.

What is known about the next steps?
