Facebook Cofounder Accuses Tesla of “Consumer Fraud on a Massive Scale”

Dustin Moskovitz accused Tesla of fraud over deferred FSD revenue and Autopark, but the report of his claims does not establish wrongdoing or a legal finding.

In April 2024, Facebook cofounder and Asana CEO Dustin Moskovitz accused Tesla of “consumer fraud on a massive scale” over how it recognized deferred revenue tied to Full Self-Driving (FSD) and Autopark. He also predicted that “people are going to jail.” Those were Moskovitz’s allegations and forecast—not findings by a regulator, court, or auditor.

What did Dustin Moskovitz allege about Tesla?

In a report published April 26, 2024, Futurism said Moskovitz based his criticism on a comparison between a Tesla graph marking one billion miles driven using FSD and a graph shown during a Tesla earnings call. The report summarizes his argument that Tesla recognized deferred revenue as earned after a wider release of Autopark, even though an earlier version of Autopark had already been released with FSD.

That account describes Moskovitz’s reasoning; it does not independently examine Tesla’s accounting records or establish that the company’s revenue treatment was improper. The report also does not provide the graphs themselves, so readers cannot use it alone to assess whether the charts measure comparable things.

Why did Autopark matter to his argument?

The point, as Futurism presents it, was timing: Moskovitz questioned whether a wider Autopark release justified recognizing deferred FSD-related revenue as earned if an earlier version of Autopark had already been available with FSD. This is an allegation about how Tesla accounted for a software feature and its release—not proof that the accounting violated a rule.

To assess that claim, a reader would need to compare Tesla’s disclosures about deferred revenue and recognition timing with what FSD and Autopark functionality was delivered, and when. Futurism’s report does not supply Tesla filings or an independent accounting analysis to settle those questions.

What did Moskovitz say about fraud and jail?

Futurism quoted Moskovitz’s Threads post as saying, “This is Enron now, folks.” It also quoted his prediction: “It may keep going, but people are going to jail at the end.” On the data presentation, Moskovitz said: “The data is presented in fraudulent ways, and it doesn’t say what they claim it says even when they make it up.”

These are Moskovitz’s words, as quoted by Futurism. The article does not establish that Tesla committed fraud, that anyone was charged or convicted, or that anyone faced jail. Its author, Frank Landymore, cautioned that an Enron-level scandal would require more evidence than a few graphs.

What does the available reporting establish—and what remains unknown?

Futurism’s April 26, 2024 report establishes that Moskovitz made the accusations and summarizes the reasoning it attributed to him. It is secondary reporting, not a company filing, regulator’s decision, court record, or audit opinion. Based on that report alone, the claim’s merits remain unverified.
