EWE Go–DCS charging-price ruling: what the reported decision means for EV drivers

Electrive reported that a Munich court found EWE Go could not maintain the higher roaming prices charged to DCS. The decision was not final, and AFIR allows price differences when objectively justified and proportionate.

On 6 October 2026, electrive reported that the Munich I Regional Court ruled EWE Go could not charge Digital Charging Solutions (DCS) the higher roaming prices at issue, including a rate above EWE Go’s own app-customer price. The decision was not final when reported, and it does not establish that every charging channel must always have an identical price. Under the EU rule at issue, differences are allowed if they are proportionate and objectively justified.

What the court reportedly decided

Electrive reported that the Landgericht München I (Munich I Regional Court) ruled in case 33 O 2062/25 that EWE Go could not maintain the higher prices it charged DCS for access to its publicly accessible charging points. The reported ruling covered the difference between the roaming price and the price for customers using EWE Go’s own charging app. The court also reportedly ordered damages for harm dating from the EU Alternative Fuels Infrastructure Regulation (AFIR) taking effect on 13 April 2024. The amount had not been determined, and the decision was not final at the time of electrive’s report.

This is a report of a German court decision, not a final, Europe-wide rule that all charging prices must match. Electrive reported the holding and reasoning; the court’s written judgment was not available in the materials for this article, so the scope described here should be understood as reported rather than independently verified from the judgment text.

What AFIR Article 5(3) requires

AFIR Article 5(3), as reproduced by electrive, says publicly accessible charge-point operators must not discriminate through the prices they charge between end users and mobility service providers, or between different mobility service providers. It allows different price levels when the difference is proportionate and objectively justified.

A charge-point operator (CPO) runs the charging station. A mobility service provider (MSP), also called an e-mobility service provider, sells drivers access through a card or app and may buy charging access from a CPO on wholesale terms. A roaming price is therefore a business-to-business charge in the supply chain; it can affect what a driver pays through a roaming service, but it is not automatically the same thing as that service’s retail tariff.

The reported significance of the case is that the court’s comparison was not limited to ad-hoc payment versus roaming. Electrive says DCS argued that an operator’s own app-contract customers also counted as end users for the Article 5(3) comparison, and describes the ruling as covering the difference between DCS and EWE Go’s direct customers. DCS’s general counsel called this an answer to whether the rule applies when a charging operator also sells its own tariff; that is DCS’s characterization, not a separate court finding.

The prices at the center of the dispute

Electrive reported the following EWE Go prices at the case snapshot, on 1 January 2025. The per-kWh prices were gross; the blocking fee was reported as net.

The reported gap between the €0.837/kWh wholesale rate and €0.52/kWh direct-customer rate was €0.317/kWh. Electrive characterized that as around 60%. These are historical case figures, not a statement of EWE Go’s current roaming rate or the price every DCS customer paid at every station.

The blocking fee was a separate issue

DCS also challenged a €0.10-per-minute blocking fee, reported as net, that applied to mobility service providers at the case snapshot but not to ad-hoc or EWE Go app customers. A blocking fee is charged for occupying a charging point beyond the relevant charging period or threshold. It is distinct from the energy price per kWh, so the ruling’s reported price-discrimination analysis should not be reduced to a comparison of energy rates alone.

What the decision does—and does not—say about EWE Go’s current tariff

The case figures should not be mistaken for today’s published EWE Go tariff. EWE Go’s tariff page, checked on 7 October 2026, lists the following terms:

The tariff page also lists no monthly base fee. These are published customer-tariff terms, not the wholesale rates disputed in the case; the 2025 litigation snapshot and the tariff checked in October 2026 concern different questions and dates.

Why EWE Go’s explanations mattered

Electrive reported that EWE Go relied on differences in costs, services, business risks and customer retention to explain the prices. According to the report, the court found those explanations insufficiently plausible to justify the price differences at issue. Article 5(3) does not prohibit every price distinction; it places the burden on the distinction to be proportionate and objectively justified. The reported outcome therefore turns on the case’s specific prices and justifications, not on a blanket ban on wholesale pricing or differentiated tariffs.

What remains unresolved

  • Finality and any appeal: EWE Go told electrive it needed to assess the reasoning before deciding how to proceed, and said it could not comment further while the proceedings were pending and the decision was not final.
  • Damages: The reported obligation covers harm since AFIR took effect on 13 April 2024, but no final amount had been determined. The decision should not be described as awarding a specific sum.
  • Broader market effects: DCS suggested the case could have wider significance, but the report does not establish that roaming prices will fall across Europe or that every operator must charge every customer the same rate.

For EV drivers, the practical point is that the price shown by an operator’s app, an ad-hoc payment method and a roaming card may differ. This case challenges whether an operator can justify charging its roaming partners more than its own customers under AFIR; it does not itself settle every retail price a driver may see.
