No—the EU has not broadly lifted its duties on Chinese electric cars. Instead, the European Commission has accepted a company-specific minimum-price undertaking for Volkswagen (Anhui)’s CUPRA Tavascan. Qualifying imports can avoid countervailing duties if they comply with the accepted price and other conditions; the duties otherwise remain in force for covered China-origin battery electric vehicles.
What changed in the EU’s China EV pricing talks?
The change is a conditional alternative to paying countervailing duties, not a general tariff repeal or blanket EU–China agreement. The Commission can assess an exporter’s proposed price undertaking under common legal criteria. In February 2026, it accepted the first identified offer: Volkswagen (Anhui)’s undertaking for the CUPRA Tavascan, with SEAT S.A. as the related EU importer.
The timeline clarifies how the policy developed:
- October 29, 2024: The Commission imposed definitive countervailing duties for five years on covered battery electric vehicles from China. It said talks on WTO-compatible alternatives and individual price undertakings would continue. European Commission announcement.
- January 12, 2026: The Commission issued guidance for offers, describing elements such as a minimum import price, sales channels, safeguards against cross-compensation, and possible future investment in the EU. It said offers would be assessed against the same legal criteria, objectively and without discrimination. Commission guidance.
- February 9–10, 2026: The Commission adopted and announced acceptance of the Tavascan undertaking. Implementing Decision (EU) 2026/328 and the Commission announcement set out the arrangement.
- April 13, 2026: In an answer to the European Parliament, the Commission said it had accepted one undertaking to date and described monitoring and enforcement. That is a dated snapshot, not a confirmed count for October 2026. Parliamentary answer E-000878/26.
Are Chinese EVs still subject to EU tariffs?
Yes. The governing measure remains Commission Implementing Regulation (EU) 2024/2754, which sets company-specific definitive countervailing duty rates from 7.8% to 35.3% for covered imports. The range is the European Commission’s rate schedule in the regulation, consolidated through February 11, 2026; the rate applicable to a particular import depends on the company and legal conditions set out there. The Tavascan undertaking does not remove these duties for other covered vehicles or exporters.
The regulation covers a defined category of new battery electric vehicles originating in the People’s Republic of China, principally designed to carry nine or fewer people, including the driver, subject to its product and origin definitions. It is not a tariff on every electric vehicle sold in Europe, regardless of origin or vehicle type. See the consolidated regulation for the legal scope and company-specific rates.

How the minimum-price route works
A price undertaking is a voluntary commitment by an exporter to sell a covered product at or above an accepted minimum import price. If the undertaking is accepted and its conditions are met, qualifying imports may be exempt from the countervailing duties that would otherwise apply. It is not simply a choice of retail price: the Commission evaluates a specific offer, product and implementation plan.
The Commission’s guidance says an offer must satisfy the legal requirements, including fully offsetting the effect of Chinese subsidisation compared with the duties and being practicable enough to reduce the risk of cross-compensation. Its January 2026 guidance says: “Each price undertaking offer is subject to the same legal criteria and the European Commission will conduct each assessment in an objective and fair manner, following the principle of non-discrimination and in accordance with WTO rules.”

The undertaking’s detailed requirements are set out in Implementing Decision (EU) 2026/328; the Commission also described monitoring and possible retroactive duty reinstatement in its April 13, 2026 answer.
Can the CUPRA Tavascan avoid the EU tariff?
Qualifying Tavascan imports covered by the accepted undertaking can be exempt from the countervailing duties, but only if the exporter and related importer meet the undertaking’s terms. Those terms include the minimum import price, an annual quota, designated sales channels, required declarations and invoices, sales reporting and verification obligations. The Commission’s announcement also identifies EU investment milestones as part of the undertaking.

So the exemption is neither automatic for every Tavascan nor a general exemption for Volkswagen, CUPRA or other Chinese-made EVs. Its reach is defined by the product and conditions in the accepted decision. If the obligations are not met, the Commission may withdraw the undertaking and reinstate duties retroactively.

The accepted arrangement establishes a minimum import price and conditions for duty exemption; it does not establish how the deal affects showroom prices, discounts, vehicle specifications or sales. An import-price floor and removal of a duty are different parts of the calculation, and the cited official decisions do not report a resulting consumer-price change. It would be premature to say the talks have made Chinese EVs cheaper.

Likewise, the Commission’s April 13, 2026 statement that one undertaking had been accepted should not be presented as the total currently accepted in October 2026: the cited official status update is dated April, and it does not verify a later count.
