The U.S. Equal Employment Opportunity Commission (EEOC) sued Tesla, Inc. in September 2023, alleging that Black employees at the company’s Fremont, California manufacturing facilities faced racial harassment and retaliation. What the EEOC alleged at Tesla’s Fremont facilities
The EEOC said Black workers had faced racial abuse, stereotyping and hostility at the Fremont facilities since at least 2015. According to the agency, racial slurs were used openly in work areas, and racist graffiti appeared on desks and equipment, in bathrooms and elevators, and on vehicles in production. The agency described the graffiti as including swastikas, threats and nooses.

The lawsuit also alleged retaliation against employees who objected to or reported racial hostility. The EEOC cited terminations, changes in job duties, transfers and other adverse actions as examples. The complaint’s claims remain allegations unless established through later court proceedings.
Why the EEOC brought the lawsuit
The agency said it investigated after a commissioner’s charge alleging violations of Title VII of the Civil Rights Act of 1964. The EEOC stated that “Title VII prohibits racial harassment and requires employers who receive harassment complaints to take prompt and appropriate action to investigate and stop it.” In this case, that was the agency’s asserted legal basis; filing suit did not itself determine Tesla’s liability.

What the EEOC asked the court to order
The agency said it sought compensatory and punitive damages, back pay, and injunctive relief intended to reform Tesla’s employment practices. Those requests describe the remedies sought in the complaint; they are not awards already made by the court.
What the 2024 ruling does—and does not—mean
The 2024 ruling described in the EEOC-filed brief addressed whether the complaint adequately alleged a groupwide hostile-work-environment claim. It allowed that claim to proceed at the pleading stage; it did not resolve whether the alleged conduct occurred or whether Tesla was legally responsible.
