Dyed Diesel vs. Clear Diesel: Uses, Taxes, and U.S. Federal Rules (2026)

Dyed diesel is reserved for qualifying nontaxable uses, while clear diesel is generally used for highway driving. Here are the federal rules, farm and business-use limits, taxes, penalties, and 2026 claim requirements.

Dyed diesel is for qualifying nontaxable uses; clear diesel is generally the choice for ordinary highway driving. The dye is a marker of tax treatment, not a permission slip: whether fuel qualifies depends on how it is used and whether federal requirements are met. As of October 12, 2026, federal rules also provide a limited way for some taxpayers to recover previously paid fuel tax when fuel is later dyed and removed from an approved terminal. State tax and enforcement rules can differ, so check the rules where the fuel will be used.

What is the difference between dyed diesel and clear diesel?

Dyed diesel, commonly called red diesel, has been marked with dye to identify fuel intended for qualifying nontaxable use. If the applicable federal conditions are met, it is exempt from most of the federal section 4081 excise tax. The IRS says dyed diesel remains subject to a $0.001-per-gallon Leaking Underground Storage Tank (LUST) tax, except for fuel for export. The dye itself does not make a use nontaxable; the actual use and the fuel’s tax treatment determine whether the exemption applies.

As an Amazon Associate I earn from qualifying purchases.

Clear diesel is undyed. It is generally sold for highway use with federal excise tax collected at sale. Someone who buys clear diesel but uses it for a qualifying nontaxable purpose may be eligible for a credit or refund, depending on the use and who is claiming it. That is a separate tax-recovery route from buying fuel that was already dyed.

Question Dyed diesel Clear diesel
Usual tax treatment May be exempt from most section 4081 excise tax for qualifying nontaxable use, subject to applicable conditions; the $0.001-per-gallon LUST tax generally remains, except for export. IRS Publication 510 (2025). Generally sold for highway use with excise tax collected at sale. IRS Publication 510 (2025).
Typical use to consider Qualifying farm use, qualifying off-highway business use, and other uses that meet a federal nontaxable-use category. Ordinary highway propulsion, including a vehicle used both on a qualifying work site and on public roads.
Can the buyer recover tax? A new, limited section 6435 payment route applies to qualifying previously taxed fuel dyed and removed from an approved terminal on or after December 31, 2025. The claimant must meet specific requirements. A qualifying nontaxable-use credit or refund may be available, depending on the use and claimant.
What does the color establish? That the fuel is marked for a specified tax treatment; it does not establish that a particular use qualifies. That the fuel is undyed; it does not prevent a qualifying user from pursuing an applicable credit or refund.

Federal requirements include compliant dyeing and, for a terminal removal, use of an approved terminal. A dyed-fuel exemption is not a general “off-road” exemption: the use must fit a specific federal category and satisfy its conditions. A state may impose additional tax, inspection, or enforcement requirements.

Can you use dyed diesel on the road?

For ordinary propulsion of a vehicle on public highways, use clear, taxed diesel. Dyed diesel is restricted to qualifying nontaxable uses, and a trip’s business purpose does not by itself turn highway driving into an exempt use. The IRS explains that certain deliveries of fuel into the supply tank of a diesel-powered highway vehicle can trigger a $0.244-per-gallon backup tax under the situation described in Publication 510 (2025). That is a tax rule for the stated circumstance, not a general substitute for checking how a specific transaction is treated.

Some federal nontaxable-use categories involve buses or school buses, but they have technical conditions. Do not assume that every bus, school-related trip, or vehicle with a work purpose qualifies. The category and the facts must fit the federal requirements; state requirements are a separate question.

Farm trucks that also use public roads

A truck does not qualify for dyed fuel on its highway miles merely because it also works on a farm. The IRS’s Publication 225 (2025), Farmer’s Tax Guide, says: “For example, you shouldn’t use dyed diesel fuel in a truck that is used both on the farm for farming purposes and on the highway, even though the highway use is in connection with farm business.” In practice, use clear diesel in a mixed-use farm truck rather than treating road trips as exempt because the truck also performs farm work.

Ask about the actual activity, not just the vehicle

“Off-road” describes where something happens, but it does not by itself identify a federal nontaxable-use category. Consider what the fuel powers, whether the vehicle is registered or required to be registered for public highways, and whether the activity meets a defined category. A machine used away from the road can still fall outside the federal business-use category if the activity is personal rather than business or income-producing.

When does farm use qualify?

Federal farm-use treatment is specific. The fuel must be used in carrying on the trade or business of farming, on a farm in the United States, and for farming purposes. IRS Publication 225 (2025) says dyed fuel must be used only on a farm for farming purposes or another nontaxable purpose. Being a farmer, owning farm equipment, or connecting a trip to farm work is not enough on its own.

  • Location: The qualifying farm use must be on a farm in the United States.
  • Purpose: The fuel must be used for farming purposes in carrying on the trade or business of farming, or for another qualifying nontaxable purpose.
  • Vehicle use: A truck also used on public highways should use clear fuel; a farm-business connection does not exempt its highway use.
  • Fuel treatment: The dye and removal must comply with applicable federal requirements, including approved-terminal requirements where relevant.

These are federal conditions, not a complete guide to every state’s rules. If equipment or a vehicle crosses state lines, or if local rules affect the tax treatment, confirm requirements for each relevant jurisdiction.

What counts as qualifying off-highway business use?

The IRS defines off-highway business use as use in a trade or business or income-producing activity, not in a highway vehicle registered or required to be registered for public highways. The category therefore turns on both the nature of the activity and the vehicle’s highway-registration status; being physically off a public road is not the only test.

Publication 510 (2025) gives stationary machines such as generators, compressors, and power saws as examples, along with forklifts, bulldozers, and earthmovers. These examples illustrate the category; they do not make every use of every listed machine automatically exempt. The use still needs to meet the definition and applicable fuel rules.

The IRS separately says nonbusiness uses such as minibikes, snowmobiles, power lawn mowers, and chainsaws are not qualifying off-highway business use. In other words, personal recreational or household use should not be treated as an exempt business use simply because the equipment does not travel on a public highway. A different nontaxable-use category would need to apply for a different result.

How much federal tax applies?

The IRS’s Treasury regulations published in Internal Revenue Bulletin 2026-21 give a federal section 4081 rate of 24.3 cents per gallon for diesel and kerosene, plus a 0.1-cent-per-gallon LUST financing rate. Publication 510 (2025) states that dyed diesel and kerosene remain subject to a $0.001-per-gallon LUST tax, except for fuel for export. These figures describe different parts of the federal tax framework: the section 4081 rate applies to taxable fuel, while the stated small LUST tax can remain on dyed fuel.

Federal figure What it applies to Source and qualification
24.3 cents per gallon Section 4081 diesel and kerosene rate. IRS Treasury regulations published in Internal Revenue Bulletin 2026-21.
0.1 cent per gallon LUST financing rate identified alongside the section 4081 rate. IRS Treasury regulations published in Internal Revenue Bulletin 2026-21.
$0.001 per gallon LUST tax on dyed diesel and kerosene, except for fuel for export. IRS Publication 510 (2025).
$0.244 per gallon Generally applicable backup tax in the described case where certain fuel is delivered into a diesel-powered highway vehicle’s fuel supply tank. IRS Publication 510 (2025); the figure applies to the situation described there.

Tax rates and their application can change. For a purchase, filing, or compliance decision, check the current IRS guidance for the relevant tax year and the rules of the state involved rather than assuming a rate shown here applies to every transaction.

Can you get a refund for clear diesel used off-road?

Possibly. The IRS recognizes credits or refunds for certain qualifying nontaxable uses of undyed fuel that was purchased with tax paid. Eligibility depends on the use and the claimant. “Used off-road” alone does not establish eligibility: a personal use excluded from the off-highway business-use category, for example, should not be treated as qualifying under that category.

The federal rules distinguish this situation from buying dyed fuel. A person claiming a credit or refund for tax paid on clear fuel needs to meet the applicable requirements for that use and claimant. The materials covered here establish that relief may be available, but do not set out every claim procedure or deadline for every nontaxable-use category. Confirm the applicable IRS form instructions for the tax year before filing.

What changed for certain dyed-fuel claims in 2026?

Section 6435 provides a payment route for qualifying diesel or kerosene on which section 4081 tax was previously paid, if the fuel is later dyed and removed from an approved terminal for nontaxable use on or after December 31, 2025. This change is narrower than a general refund for anyone who buys dyed diesel.

The IRS’s April 2026 guidance and May 2026 Schedule 5 instructions specify that the claimant must be the person who paid and reported the earlier section 4081 tax, and that the tax must not already have been credited or refunded. The May instructions identify Schedule 5 (Form 8849), line 9, for dyed diesel claims. The date refers to when qualifying fuel is dyed and removed from an approved terminal—not simply when a purchaser buys or uses any dyed fuel.

  1. Check the fuel’s history. Establish that section 4081 tax was paid and reported on the fuel before it was dyed.
  2. Check who is claiming. The claimant must be the person who paid and reported that earlier tax.
  3. Check the qualifying removal. The fuel must be dyed and removed from an approved terminal for nontaxable use on or after December 31, 2025.
  4. Check for an earlier recovery. The tax cannot already have been credited or refunded.
  5. Use the designated filing instructions. The May 2026 instructions direct dyed diesel claims to Schedule 5 (Form 8849), line 9. Follow the current form instructions to establish and report eligibility.

A later buyer who did not pay and report the original section 4081 tax does not meet the identified claimant condition just by purchasing fuel that was dyed. Nor does the new route erase the requirement that the ultimate use qualify as nontaxable.

What happens if you use dyed diesel for a taxable purpose?

Under the IRS description, a person who holds dyed fuel for use or uses it for a taxable use, knowing or having reason to know it is dyed, can face a penalty equal to the greater of $1,000 or $10 per gallon involved. The $1,000 portion increases after the first violation. Any applicable tax is imposed in addition to the penalty.

The penalty figure is not a complete statement of every possible consequence. State rules are not resolved by the federal IRS sources described here, and state taxes, inspection rules, and penalties can differ. If dyed fuel was used in a questionable situation, preserve purchase and use records and consult current IRS guidance and the relevant state tax authority rather than assuming that paying a tax amount alone resolves the matter.

How to choose fuel before filling up

  1. Identify the equipment and use. Write down what the fuel will power and whether the activity is farming, a business or income-producing activity, highway propulsion, or a different use.
  2. Check highway status. If a vehicle is registered or required to be registered for public highways, assess whether its use falls within a qualifying federal category; do not assume an off-road leg or work purpose makes the fuel exempt.
  3. Match the activity to a federal category. Verify the exact conditions for farm use, off-highway business use, or another applicable category. Do not rely on “off-road,” “farm-related,” or a machine’s label alone.
  4. Confirm how the fuel was treated. For dyed fuel, confirm that the dyeing and any terminal removal meet federal conditions. If considering a tax credit or refund for clear fuel, identify who paid the tax and which claim rules apply.
  5. Check state rules. Confirm tax, inspection, and enforcement requirements in the state where the fuel will be used. The federal baseline does not supply a state-by-state answer.
  6. Keep the records needed to support the treatment. Retain fuel purchase and tax information, details of the equipment and its use, and any records relevant to a claim. For a section 6435 claim, the original payment and reporting, terminal removal, claimant, nontaxable purpose, and absence of a prior credit or refund all matter.

Common situations and the right question to ask

  • A tractor doing qualifying farm work on a U.S. farm: Does the fuel meet the farm-use conditions, including use for farming purposes in carrying on the farming business?
  • A farm truck that also drives on public roads: Do not treat highway use as exempt because the truck also works on a farm; the IRS advises using undyed fuel in that mixed-use truck.
  • A generator or bulldozer used in a business: Is the activity a trade or business or income-producing activity, and is the vehicle or machine outside the highway-registration condition that defines the business-use category?
  • A personal lawn mower, snowmobile, or chainsaw: The IRS says these nonbusiness uses are not qualifying off-highway business use. Do not assume physical location makes them exempt under that category.
  • Clear diesel used in a qualifying nontaxable activity: Is the particular use eligible for a credit or refund, and is the person seeking recovery an eligible claimant?
  • Fuel taxed before being dyed for nontaxable use: Does it meet the section 6435 date, approved-terminal, original-taxpayer, and no-prior-recovery conditions?
