No final record here shows Tesla has lost the U.S. “CYBERCAB” trademark. Two Tesla applications received nonfinal USPTO refusals in October 2025, and Tesla later opposed an earlier-filed application by Unibev. The Trademark Trial and Appeal Board docket checked for this article lists that opposition as pending. Those are separate proceedings, and neither establishes that Tesla is barred from using the name in every context.
What the trademark record shows
The headline claim that Tesla “lost” the mark goes further than the official record supports. The USPTO issued examination-stage actions against two Tesla applications; separately, Tesla filed an opposition to Unibev’s CYBERCAB application. An examiner’s nonfinal action is not a final decision in the overall dispute, and an opposition filing records a contested case rather than its outcome.

Why Tesla’s applications received USPTO objections
Application 99185836
In its October 6, 2025 nonfinal action, the USPTO identified Unibev application 79412082 as an earlier-filed application that could bar Tesla’s registration if it registered. The examiner also refused registration under Section 2(d), citing U.S. Registration No. 5963829, and raised requirements concerning the identification of services and multiple classes. The action’s wording was: “Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 5963829.” That is the examiner’s statement about Tesla application 99185836—not a final ruling on all CYBERCAB applications or on Tesla’s ability to use the name. Application 99211146
The October 22, 2025 nonfinal action concerns a different Tesla file. It refused registration under Section 2(d) based on U.S. Registrations Nos. 5963829 and 7854028, and separately identified a potential conflict with Unibev’s prior-filed application 79412082. These are examination issues in application 99211146, not a decision in Tesla’s opposition against Unibev. Read the October 22 office action.

Tesla and Unibev are litigating a separate application
Unibev filed application 79412082 for CYBERCAB on October 28, 2024, according to Tesla’s notice of opposition. After publication on January 13, 2026, Tesla filed opposition 91305433 on February 18, 2026. TTABVUE records Unibev’s answer on April 23, 2026, and listed the case as pending when checked. The Board docket is the place to distinguish that contested proceeding from the USPTO’s examination of Tesla’s own applications. Check the TTABVUE docket.
Bad faith is Tesla’s allegation, not an established finding
Tesla’s notice of opposition characterizes Unibev’s conduct under the heading “APPLICANT’S HISTORY OF BAD FAITH TRADEMARK SQUATTING.” That wording describes Tesla’s position in the case; it is not a finding by the USPTO or the Board. Unibev’s answer denies the bad-faith allegations and admits, among other specified facts, that it filed a French CYBERCAB application on April 29, 2024. The cited docket materials do not record a ruling on the bad-faith allegations. Tesla’s opposition and Unibev’s answer are listed in TTABVUE.

What “losing the trademark” would—and would not—mean
A trademark application is a request for registration; a registration is a federal record of registered rights; and the practical ability to use a name is a distinct question. The October 2025 actions addressed whether particular Tesla applications could proceed to registration under the issues raised by the examiner. They do not, by themselves, establish that Tesla is generally prohibited from using “Cybercab.” Likewise, Tesla’s opposition challenges Unibev’s application but does not establish that Tesla has prevailed.
Procedural status can change. The cited TTABVUE docket listed opposition 91305433 as pending and included Unibev’s April 23, 2026 answer; consult the current docket for any later orders or disposition.
