Personal dashcams and fleet cameras can capture the same road, but workplace systems raise extra privacy questions: employers may monitor drivers and passengers, record behavior over time, and control footage collected during work. In the UK, the key differences are the purpose of recording, who controls it, whether audio is on, whether a vehicle is used privately, and how people are informed and footage is managed. The rules depend on jurisdiction and use; there is no single worldwide rule for every dashcam.
What makes a fleet camera different from a personal dashcam?
The hardware may look similar, but the person or organization deciding why and how recording happens matters. A personal dashcam is commonly used for evidence or vehicle protection, though the rules still depend on the circumstances and local law. A fleet camera is deployed by an employer, which must be able to explain its purpose and lawful basis for processing identifiable footage. The UK Information Commissioner’s Office (ICO) treats worker monitoring as a heightened privacy concern.
Identifiable images are personal information under UK data protection guidance. Either type of camera may capture other motorists or pedestrians; a fleet system may also record its driver and passengers inside the vehicle. The ICO advises employers to consider whether a less intrusive approach could meet the same objective before monitoring workers.
How the rules differ in practice

Why audio recording needs special care
Audio can reveal conversations that video alone would not capture, including discussions unrelated to driving. The ICO says: “Dashcams with audio recording capabilities present higher risk, and so you should switch off any capability to record audio by default.” It says audio should be used only in exceptional circumstances; continuous recording needs strong justification and a documented risk assessment. A camera’s audio setting is therefore a privacy decision, not merely a product feature. See the ICO guidance on specific worker-monitoring methods.

What changes when a work vehicle is used privately?
Work and personal journeys do not create the same monitoring context. The ICO says monitoring during private use of a work vehicle will rarely be justifiable and describes continuous recording outside working hours as likely excessive. Where a vehicle may be used privately, drivers should have a way to deactivate monitoring for those periods. Employers should account for that use when defining the system’s purpose and settings rather than assuming a work vehicle is always being used for work.
What employers should put in place
For UK vehicle surveillance, the ICO calls for a data protection impact assessment (DPIA); it also identifies high-risk driver monitoring as a situation requiring DPIA consideration. A workable deployment should set out why monitoring is needed and how it will be limited, explained, and governed.

- Define the purpose and lawful basis. State what the camera is intended to achieve and consider whether a less intrusive method would work.
- Assess privacy risk. Complete a DPIA for vehicle surveillance and for high-risk driver monitoring, documenting the risks and safeguards.
- Set recording boundaries. Decide whether video is needed, keep audio off by default, and provide a way to stop recording during private use where relevant.
- Tell people what to expect. Inform workers and passengers, use clear signage, and provide privacy information explaining when surveillance may occur and whom to contact.
- Control footage throughout its life. Establish retention and deletion practices, a process to retrieve recordings, procedures for access requests, and safeguards for disclosures.
These are governance decisions, not a guarantee of compliance: the legal basis, notice, access rights, and retention approach must fit the actual system and its circumstances. The ICO’s vehicle-surveillance checklist and worker-monitoring guidance provide UK-specific detail.

No. The detailed employer guidance above is UK-specific, and national laws can add requirements. At EU level, the European Data Protection Board (EDPB) wrote on 5 May 2025 that organizations processing personal data through dashcams or in-car cameras should assess their role under the GDPR in light of the circumstances, evaluate processing risks, and meet obligations including transparency and data-subject rights, while respecting stricter national regimes. Its position does not resolve every country’s specific rules, and it does not establish state-by-state requirements in the United States.
