Mercedes-Benz could receive special treatment in political negotiations over a proposed U.S. connected-vehicle bill, but no Mercedes-specific exemption has been established. The company’s two disclosed China-linked stakes add up to 19.67%, above the 15% threshold Associated Press reported for the proposal. That proposed threshold is separate from the federal rule already in effect, which uses a control-and-technology test rather than a simple ownership percentage.
Why Mercedes-Benz is part of the debate
Mercedes-Benz Group AG’s shareholder page lists BAIC Group with 9.98% of registered capital and investor Li Shufu with 9.69% through Tenaciou3 Prospect Investment Limited. Added together, those disclosed positions equal 19.67%. That is an arithmetic sum of the company’s two figures, not an aggregate published by Mercedes-Benz. Associated Press reported that a proposed bipartisan Senate bill would use a 15% Chinese-ownership threshold. On that reported basis, Mercedes-Benz could fall within the proposal’s scope. The stakes alone do not mean the company is currently banned, however, and the proposal’s reported threshold should not be confused with the existing Commerce Department rule.
What the proposed Senate bill could mean
As described by AP, the bill would bar the import, manufacture, sale, resale, or introduction into interstate commerce of connected vehicles and related software and hardware associated with China, Russia, Iran, or North Korea. AP reported that the proposal’s 15% Chinese-ownership threshold could reach Mercedes-Benz despite the stakes being characterized as passive. The exact legislative text is not established here, so the reported threshold and scope should be attributed to AP rather than treated as a final enacted standard. Associated Press report

On September 30, 2026, the Senate delayed action while negotiations with a holdout continued, according to AP. The bill therefore remained unsettled at that point; the delay was not an exemption for Mercedes-Benz.
Why a carve-out is being discussed
Sen. Bernie Moreno, an Ohio Republican and bill co-sponsor, said: “We’re not going to have the president of the United States sign a bill — nor would he — that bans Mercedes-Benz from the United States of America.” He added, “We have to figure out a way to manage all of that.” The remarks show political pressure to address Mercedes-Benz’s position, but they are not bill text, a legal determination, or a promise that an exemption will be adopted. The existing Commerce Department rule is a different legal track
The Commerce Department’s Bureau of Industry and Security (BIS) finalized its Connected Vehicles Rule on January 14, 2025, and it took effect March 17, 2025. It covers specified Vehicle Connectivity System (VCS) hardware and software, as well as Automated Driving System (ADS) software, when design, development, manufacture, or supply has a defined connection to China or Russia. BIS describes VCS as systems that let a vehicle communicate externally, including telematics control units and Bluetooth, cellular, satellite, and Wi-Fi modules. Bureau of Industry and Security

The rule’s timing depends on the covered component or activity. Software-related prohibitions generally begin with model year 2027. VCS hardware prohibitions begin with model year 2030, or January 1, 2029, for units without a model year. Separate restrictions on covered sales by connected-vehicle manufacturers owned by, controlled by, or subject to the jurisdiction or direction of China or Russia also begin with model year 2027, including vehicles made in the United States. Why 19.67% does not decide the BIS question
BIS expressly declined to set a fixed ownership threshold. Its control analysis considers whether a party can determine important matters, including through voting interests, board representation, proxy voting, special shares, contracts, other arrangements, or acting in concert. The disclosed 19.67% is relevant context, but by itself it does not establish whether Mercedes-Benz meets the rule’s ownership, control, jurisdiction, or direction standards. BIS provides general authorizations for certain limited circumstances and allows applications for specific authorization for otherwise prohibited transactions. A specific authorization requires a case-by-case showing that the transaction does not pose an undue or unacceptable national-security risk. BIS says the conditions for its published general authorizations exclude entities owned by, controlled by, or subject to the jurisdiction or direction of China or Russia. Ars Technica reported that Volvo Cars received a Commerce Department authorization in May 2026 despite its Chinese ownership links. That example demonstrates an authorization path exists under the current rule; it does not show that Mercedes-Benz applied, qualifies, or received approval. Ars Technica report
What is known—and not known—about Mercedes-Benz’s status
- Known: Mercedes-Benz’s shareholder page lists BAIC Group at 9.98% and Li Shufu through Tenaciou3 at 9.69%; together they total 19.67%.
- Reported about the proposal: AP described a 15% Chinese-ownership threshold and reported that the Senate delayed action on September 30, 2026.
- Not established: A Mercedes-specific exemption, authorization, application, or definitive legal outcome under either the BIS rule or the proposed bill.
Accordingly, “could escape” describes a possible political accommodation or future exemption—not an accomplished legal result. Whether the proposal advances, what its final language says, and whether Mercedes-Benz receives any special treatment remain unresolved on the reported facts.
