What China’s new battery rules require
A six-department interim measure, promulgated on December 31, 2025, and published by China’s Ministry of Industry and Information Technology (MIIT) on January 16, 2026, took effect on April 1, 2026. It governs the collection and comprehensive utilization of retired new-energy-vehicle (NEV) power batteries in mainland China. MIIT coordinates the regime alongside the National Development and Reform Commission, the Ministry of Ecology and Environment, the Ministry of Transport, the Ministry of Commerce and the State Administration for Market Regulation. Codes and traceability
Battery producers and importers must code cells, modules and packs and affix labels that are unique, accurate, visible, durable and difficult to replace. The rules provide for a national information platform to track batteries through production, sale, repair, replacement, dismantling, collection and utilization. Battery companies must give vehicle makers and repair businesses the codes and necessary dismantling information.

This is intended to make the battery’s path legible beyond its first installation in a vehicle. Traceability is not just paperwork: it links identification and information-sharing duties to collection and end-of-life handling.

Who is responsible for collection?
Battery and vehicle manufacturers have recovery responsibilities, among other participants. The measure encourages them to establish collection-service outlets in line with the relevant national service-network standard. Workshops and other actors also have duties under the broader regime; the rules do not make a retired pack an owner’s do-it-yourself disposal project.
What counts as recovery?
The measure defines comprehensive utilization to include dismantling, crushing, sorting, smelting and other treatment for resource use. Operators must meet applicable safety and environmental requirements, complete project approval or filing and environmental assessment processes, and hold or register the required pollution permits. Those requirements make battery recovery a regulated industrial activity, not a task for an informal dismantler.

Can retired EV batteries be reused?
China’s policy distinguishes cascade use—putting a retired battery into another application—from processing it to recover materials. On July 30, 2026, MIIT announced changes to the rules for cascade-use firms: it removed the relevant clauses from the 2024 industry conditions, ended the public announcement management system for those firms, and retained the published list of recycling firms. The specified prohibition covers batteries used as complete packs or, after separation, reassembly or related processing, as packs, modules or individual cells. MIIT also called for relevant cascade-use standards and organizational activities to be revised or discontinued.

This is not evidence that every second-life use has been outlawed. The notice changes specified policy and prohibits certain applications; it does not establish a blanket ban on all reuse. Whatever the application, products made from retired batteries still have to satisfy the applicable quality requirements.
Why enforcement is part of the system
A five-department notice published on April 28, 2026, announced a nationwide joint enforcement action. It names improper sale or handoff of retired batteries, noncompliant products made from used batteries, failures to meet traceability requirements, illegal dismantling and pollution, and unlicensed business activity as enforcement priorities. The priorities show the kinds of weak links authorities are targeting between retirement and compliant processing. They do not show how frequent those violations are, or quantify illegal trade or dismantling.
What is known about the scale—and what is not
At a May 28, 2026, working-group meeting, MIIT described China’s NEV power batteries as having entered a phase of large-scale retirement and called for a long-term mechanism. That is an official qualitative assessment, not a published retirement forecast.

The cited official material does not establish a total retirement volume, a retirement curve, compliant processing capacity, costs or recovery yields by chemistry or process. Without those figures, it is not possible to say how quickly capacity is catching up, how much material China will recover, or which pathway is economically or environmentally superior.
What this means for EV owners
The rules put responsibility for an orderly end-of-life chain on manufacturers and other regulated participants, supported by identification, information-sharing and collection networks. For an owner, the practical implication is to use the vehicle maker or an authorized repair or collection channel when a traction battery needs replacement or retirement, rather than sell or hand it to an unverified buyer. The policy’s focus on proper handoffs and qualified operators makes that distinction important.
