Canada has created a limited, permit-controlled route for Chinese-origin electric vehicles at a 6.1% tariff, while the U.S. policy documented by the Office of the United States Trade Representative (USTR) sets a 100% Section 301 tariff rate on Chinese EVs. That sharp policy difference is evidence against an immediate U.S. copy of Canada’s approach—not a guarantee about what Washington will decide later.
What Canada’s new policy allows
Canada’s January 2026 arrangement establishes an initial annual quota of 49,000 Chinese-origin electric vehicles. Eligible vehicles imported within the quota face the 6.1% most-favoured-nation (MFN) tariff rate. Canada repealed the 100% surtax that had applied since October 2024 for imports eligible under this quota; the change is a capped opening, not duty-free or unrestricted access. Global Affairs Canada’s announcement describes the quota and tariff terms, while the regulatory order records the surtax repeal.
Permits and quota periods govern access
Importers need to operate within the permit and quota system. Global Affairs Canada’s Import Notice No. 1168 says the second period of quota year one runs from September 1, 2026, through February 28, 2027. It makes 24,500 vehicles available for that period, plus any unused volume from the first period. That is an available import quantity, not a forecast of how many vehicles will arrive or be sold.
Canada’s customs guidance says the Import Control List was amended effective March 1, 2026, to cover Chinese-origin EVs. The notice lists exceptions for certain temporary imports and personal, non-commercial imports classified under Chapter 98. Those exceptions do not turn the quota into a general consumer-import route.

Origin matters more than the badge
The rules concern country of origin and customs classification, not simply the nationality of a car brand. The notice says a complete knock-down EV kit substantially manufactured in China and exported for assembly in Canada or another country is still treated as originating in China. Assembly elsewhere does not automatically take a vehicle outside the regime.
How the U.S. policy differs
USTR announced in May 2024 that the United States would raise its Section 301 tariff rate on Chinese EVs to 100% in 2024, then finalized the action on September 13, 2024. That is a very different market-access framework from Canada’s quota plus 6.1% MFN tariff. The USTR’s final action establishes the 100% rate. It is the rate in that 2024 action; a later change, exclusion or court development would need to be checked against current U.S. policy before treating it as unchanged.

There is also an important distinction in the public record. On August 29, 2024, then-U.S. Trade Representative Katherine Tai praised Canada’s restrictive move at the time, saying: “Canada’s actions are an important step towards ensuring workers and businesses can compete fairly in the electric vehicle, steel, and aluminum industries.” That statement addressed the policy Canada had announced in 2024; it is not U.S. endorsement of Canada’s 2026 quota opening. Tai’s statement provides the context.
Will Washington follow Canada?
The documented policies point in opposite directions: Canada has opened a limited, quota-based route, while the U.S. established a 100% Section 301 tariff rate. On that evidence, a near-term U.S. move to Canada’s lower-tariff model looks unlikely unless there is a substantial policy shift or negotiated change. The official material cited here does not establish that Washington has announced such a shift in response to Canada’s 2026 action.

That is a bounded assessment, not a prediction of every future trade decision. U.S.-Canada-Mexico Agreement (USMCA) automotive discussions may be relevant context, but USTR’s automotive dialogue page, which lists a 2026 automotive report, does not itself announce a change to U.S. Chinese-EV tariff policy. Future talks or a later U.S. review could change the picture; the cited policy documents do not settle those outcomes.
