Under India’s Central Motor Vehicles Rules, a two-wheeled pure electric vehicle is not deemed a motor vehicle only when it meets every specified technical condition and those conditions are verified and authorised by a testing agency specified under rule 126. Only for a vehicle that qualifies on that basis do the ordinary motor-vehicle licence and registration requirements not apply.
What makes an electric scooter exempt?
The Central Motor Vehicles (Ninth Amendment) Rules, 2023 set out an exclusion for a two-wheeled pure electric vehicle. The rule begins: “Provided that a two wheeled pure electric vehicle shall not be deemed to be a motor vehicle if all the following conditions are verified and authorised by any testing agency specified in rule 126, namely:-” Ministry of Road Transport and Highways (MoRTH), 2023 amendment.

- Maximum speed: less than 25 km/h.
- Unladen weight: no more than 60 kg, excluding the battery.
- Safety equipment: suitable brakes and the required reflectors.
These are the rule’s thresholds: “less than” applies to both power and speed, while the weight limit is “not more than” 60 kg. A scooter advertised as 250 W or capped at 25 km/h does not, on those numbers alone, establish that it qualifies.

Why the seller’s “no licence” claim is not enough
The exemption depends on the exact vehicle meeting all the conditions and having the required testing-agency verification and authorisation. A product page’s “no licence,” “no registration” or “low speed” wording is a marketing claim, not proof of regulatory status.
Before buying, ask the manufacturer or seller for documentation identifying the exact model and showing its rule 126 verification and authorisation. Check that the paperwork covers the technical conditions that apply to that vehicle; do not infer compliance from a speed limiter or a headline specification. The available evidence does not establish rule 126 authorisation for any particular currently sold scooter.

Does the same test apply to pedal-assist vehicles?
Pedal-assist vehicles have additional requirements. Their motor output must reduce progressively and cut off as the vehicle reaches 25 km/h, or sooner if the cyclist stops pedalling. That cutoff behaviour is part of the applicable criteria, not a substitute for the other relevant conditions and testing-agency authorisation.

What about the registration-fee exemption?
Keep registration status separate from registration fees. MoRTH’s 2021 notice concerns exemption from registration fees for battery-operated vehicles; a fee exemption is not, by itself, an exemption from registering a motor vehicle. The separate low-speed provision matters because a qualifying vehicle is not deemed to be a motor vehicle under the stated conditions. MoRTH notice on registration-fee exemption.

How to check a scooter before you buy
- Identify the exact model and variant. Ask for the manufacturer’s documentation for the vehicle you intend to purchase, not just a generic claim about a product range.
- Check the technical criteria. Confirm thirty-minute motor power is less than 0.25 kW, maximum speed is less than 25 km/h, unladen weight excluding the battery is no more than 60 kg, and the required brakes and reflectors are present.
- Check pedal-assist behaviour, if applicable. Confirm motor output reduces progressively and cuts off at 25 km/h or sooner if pedalling stops.
- Request proof of verification and authorisation. The documentation should show that the conditions have been verified and authorised by a testing agency specified in rule 126.
- Do not decide from a listing alone. A claimed speed limit or “no RTO registration” label does not document the complete legal test.
ARAI describes its two-wheeler type-approval scope for electric vehicles above 250 W and with a maximum design speed above 25 km/h. That scope information does not establish whether an under-threshold scooter has the separate rule 126 authorisation required for this exclusion. ARAI.
