Can EVs Use HOV and Express Lanes? Rules After the Federal Exemption Expired

The federal exemption for solo EV use of HOV lanes expired in 2025, but EVs are not categorically barred. Learn how to check occupancy, toll and transponder rules for your route.

Yes, but not automatically because a vehicle is electric. The federal authorization that let states allow certain solo plug-in electric and alternative-fuel vehicles to use HOV lanes expired on September 30, 2025. EV drivers can still use a lane by meeting its posted occupancy requirement, and a tolled express lane may also admit solo drivers who pay. Check the signs and the road operator’s current rules for your specific route.

What changed for solo EV drivers?

Until September 30, 2025, federal law authorized states to let certain single-occupant plug-in electric and alternative-fuel vehicles use HOV facilities without meeting the usual occupancy rule. That authorization has expired. In a November 22, 2024 memorandum, the Federal Highway Administration (FHWA) described the expiration and the federal vehicle categories that may qualify under the post-expiration framework. FHWA also states that, apart from the statutes and regulations it cites, the memorandum is informational and does not bind states or the public. Read the FHWA memorandum.

The practical result is that an EV no longer gets a general federal exemption to travel alone in an HOV lane. It may still qualify by carrying the number of occupants shown on the signs, or it may use a tolled lane under that facility’s payment rules. States and road operators administer their lanes, so there is no single nationwide EV lane rule.

HOV lanes and express lanes are not the same

An HOV lane restricts access based primarily on the number of people in a vehicle, with rules and exceptions set for that facility. An express lane may be an HOV lane, a tolled lane, or a facility combining both approaches. Depending on the road, an eligible carpool may travel without charge while a solo driver can enter by paying a toll. EV status alone does not determine whether you can enter or whether you owe a toll.

Before using a lane, establish these details for the exact route:

  • Occupancy: Is the requirement HOV-2+ or HOV-3+, and does it apply at all times?
  • Schedule: Which days, directions and hours are restricted?
  • Payment: Can a solo driver use the lane by paying, and how is the toll collected?
  • Transponder setting: Does toll-free carpool travel require a particular transponder in an occupancy mode?
  • Exceptions: Does the official operator identify any vehicle-specific exception? Do not assume an EV plate or decal is still sufficient.

Examples show why the route matters

These official examples illustrate different rules; they are not a complete guide to every road in each jurisdiction. Operating times and details can change, so confirm them with the operator before driving.

California: occupancy and schedules vary by route

Caltrans says California’s clean-air-vehicle decal exemption expired September 30, 2025. HOV access generally covers vehicles meeting the posted occupancy rule, as well as categories such as motorcycles and transit vehicles. The threshold may be 2+ or 3+ occupants, and schedules vary by region and route. Follow the signs on the highway for the applicable rule. See Caltrans clean-air vehicle information.

Arizona: alternative-fuel plates no longer replace occupancy

ADOT says alternative-fuel vehicles and vehicles with Energy Efficient plates no longer qualify to use HOV lanes with fewer than two people following the federal change. ADOT also lists a separate Arizona exception, effective September 12, 2026, for blood-transport vehicles. That exception is not an EV privilege. Check ADOT’s alternative-fuel vehicle guidance.

Georgia: I-85 toll-free access requires three occupants

Georgia DOT says ordinary HOV occupancy rules apply after the federal AFV exemption ended. On the I-85 Express Lanes, toll-free AFV access requires three or more occupants, including the driver. A driver traveling alone should check the facility’s toll rules rather than assume EV status grants free entry. See Georgia DOT Express Lanes information.

Virginia: I-66 has time-specific HOV and toll rules

VDOT says vehicles with clean special-fuel plates have no current exception from HOV or HOT requirements after the federal authorization expired. On I-66 Inside the Beltway, tolling and occupancy requirements depend on direction and time. During operating hours, a driver pays with E-ZPass or uses E-ZPass Flex set to HOV mode for toll-free HOV-3+ travel. VDOT says there are no toll or HOV requirements outside the stated hours. Hawaii: the change also affected EV plates

HDOT announced that, starting September 30, 2025, single-occupancy EVs with EV plates would no longer be permitted in HOV lanes during restricted periods. Follow local signs and current HDOT guidance for the applicable lane schedule. See Hawaii DOT highway information.

Do you need an E-ZPass Flex?

Only if the rules for your particular facility call for it. On I-66 Inside the Beltway, VDOT identifies E-ZPass Flex in HOV mode as the method for toll-free HOV-3+ travel during operating hours; E-ZPass is used to pay tolls. That does not make E-ZPass Flex a universal requirement for EVs or for all express lanes. Verify the operator’s transponder and occupancy-mode instructions for your route.

What about British Columbia?

The U.S. federal change does not govern other jurisdictions. British Columbia maintains its own rules for eligible plug-in hybrid and battery-electric vehicles in designated HOV lanes; its guidance says those vehicles no longer need a visible OK decal where lane signage permits use. The province also says hydrogen fuel-cell vehicles may use designated signed lanes starting April 1, 2026. These are British Columbia rules, not a general North American exemption. Why posted rules and enforcement matter

HOV and managed lanes depend on drivers following occupancy rules. Caltrans’ 2026 California HOV Facilities Degradation Action Plan cites a 2024 estimate that 39% of occupancy declarations in managed lanes were misrepresented. That is a Caltrans estimate about managed lanes, not a national figure or an EV-specific measure. The plan also says roughly 75% to 86% of vehicles on California’s I-10 and I-110 ExpressLanes were single-occupant vehicles, in the context of those corridors and the analysis it cites. A quick pre-drive check

  1. Identify the exact road and lane, not just the state or the word “express.”
  2. Read the operator’s current page for occupancy, hours, direction and any toll-free carpool conditions.
  3. Check whether solo entry is allowed for a toll and what transponder or account is required.
  4. Set any HOV-mode transponder only when you meet the posted occupancy rule and the facility’s instructions.
  5. Use roadside signs as the final guide to the restriction in effect on that segment.
