The settlement in Kimball v. Volkswagen Group of America, Inc. covers certain Audi and Volkswagen turbocharger failures—not every EA888 engine problem. It received final court approval, but eligibility depends on the vehicle’s VIN and the settlement’s conditions. The deadline to submit past-repair reimbursement claims was November 29, 2025, and the settlement website reports that claim determination notices were mailed June 11, 2026.
What the Audi and VW settlement covers
The case, Kimball v. Volkswagen Group of America, Inc., Civil Action No. 2:22-cv-04163-MAH, concerns allegations that certain VW and Audi turbochargers were defective and could fail prematurely. Volkswagen Group of America denied that the turbochargers were defective or that it violated warranties or laws. The settlement resolves the allegations; it is not a court finding that the vehicles had a defect or an admission of liability.
This is a turbocharger and wastegate settlement, not a general settlement for every EA888 engine issue. The settlement website says the court did not decide in favor of either party. The [filed Final Order and Judgment](https://www.turboclasssettlement.com/admin/api/connectedapps.cms.extensions/asset?amp%3Binline=true&id=a403a9d2-61d3-4d05-8e55-6202c287631b&languageId=1033) grants final approval and dismisses the action with prejudice. The settlement website also contains older boilerplate saying approval is pending, so rely on the filed order for approval status.
How to check whether your vehicle is included
The class is limited to people or entities who purchased or leased qualifying vehicles distributed by Volkswagen Group of America in the United States or Puerto Rico. A model and model year on the settlement’s example list do not establish eligibility: coverage is determined by VIN, and not every vehicle in a listed year qualifies.

Use the official settlement website to look up the VIN or contact the settlement administrator. The examples below show the model-year ranges identified on the site, but each vehicle still needs VIN confirmation.

What benefits does the settlement provide?
Generation 3 warranty extension
For qualifying Generation 3 vehicles, the settlement provides coverage for 50% of the cost of repair or replacement, including parts and labor, at an authorized Audi or Volkswagen dealer when turbocharger failure is caused by corrosion of the wastegate fork-head and/or link-pin. The coverage period runs until 8.5 years or 85,000 miles from the vehicle’s in-service date, whichever occurs first. A special timing provision applies to vehicles already more than 8.5 years old on September 15, 2025.
Coverage remains subject to original warranty terms and exclusions. The settlement excludes failures related to abuse, misuse, modification, inadequate maintenance, collision, vandalism, impact or other outside damage. This extension is limited to qualifying Generation 3 vehicles and the specified corrosion-related failure mode; it does not establish coverage for every turbocharger repair.

Reimbursement for one qualifying past repair
The agreement allows reimbursement for one qualifying repair paid for before September 15, 2025, if it was completed within 8.5 years or 85,000 miles from the vehicle’s in-service date. Which failure cause qualifies depends on generation: Generation 1 and 2 repairs must relate to wear at the wastegate link plate and pin; Generation 3 repairs must relate to corrosion of the fork-head and/or link-pin.
- If the repair paperwork identifies the qualifying cause, reimbursement is 50% of the eligible expense paid.
- If the paperwork does not identify the cause, 40% may be available if the claimant also supplies the required oil-maintenance records.
- For a non-dealer repair, the percentage is applied to no more than $3,850 of invoice expense.
- Claimants must provide an invoice and proof of payment. Additional proof may be required, including a declaration or evidence that an authorized dealer declined or could not perform the repair under warranty.
Reimbursement is not necessarily the full amount of the original repair bill. The agreement and official FAQ set out the conditions and supporting documents.

Are claims still open, and what is the case status?
No. The deadline to submit a past-repair reimbursement claim was November 29, 2025. The settlement website reports that claim determination notices were mailed to all claimants on June 11, 2026. That mailing date does not establish the result of any individual claim; claimants should contact the settlement administrator to check their own status.
The court granted final approval in an order filed in the District of New Jersey. The final-approval materials describe an estimated 3.9 million settlement class members, 16 purported objections and approximately 265 timely and valid requests for exclusion. Those figures describe the case and class process; they are not counts of defective vehicles or successful claims.

What the settlement does—and does not—mean
Final approval makes the settlement binding under its terms; it does not prove the allegations or show that VW/Audi admitted wrongdoing. The practical questions for an owner are whether the VIN is included, whether the repair or failure matches the covered cause, and whether the applicable time, mileage and documentation conditions are met. For a past repair, the submission deadline has passed, while the Generation 3 extension is subject to the settlement’s eligibility and coverage terms.
