Are Republicans Trying to Get Rid of AEB? What the Record Shows

Republicans have scrutinized the cost and performance of vehicle safety technology, but the cited evidence does not establish a plan to eliminate AEB. The federal requirement remains in place, with a possible compliance extension listed as planned rulemaking.

Not on the evidence cited here. Republicans have questioned the cost and performance of vehicle safety technology amid concern over high car prices, but the available reporting does not establish a formal Republican proposal to eliminate automatic emergency braking (AEB). A federal rule requiring AEB on new passenger cars and light trucks remains in place; a separate agenda item proposes considering more time for automakers to comply, not repealing the requirement.

What Republicans have said about AEB

Axios reported on November 26, 2025, that Republicans had summoned U.S. auto executives to a January hearing to explain high vehicle prices. The report identified AEB among technologies blamed for adding to vehicle costs. That is evidence of political scrutiny focused on affordability and technology performance; it is not evidence that Republicans as a group introduced a plan to remove AEB. Axios’s report does not establish a repeal proposal.

Those are distinct policy questions: whether a safety system is worth its cost, whether its required performance or testing should change, how long manufacturers should have to comply, and whether the requirement should be abolished. The sources identified here support scrutiny and a possible compliance extension, not the last of those steps.

What the federal AEB rule requires

The National Highway Traffic Safety Administration (NHTSA) finalized Federal Motor Vehicle Safety Standard No. 127 on April 29, 2024, implementing a mandate in the Bipartisan Infrastructure Law. It requires automatic emergency braking, including pedestrian AEB, on new passenger cars and light trucks by September 2029. AEB detects an imminent collision using sensors and applies the brakes automatically if the driver has not done so.

The standard sets performance requirements for lead-vehicle and pedestrian scenarios, defines testing procedures, includes tests for two false-activation scenarios, and requires driver notification when the system has a qualifying malfunction. NHTSA describes lead-vehicle braking performance up to 90 mph and pedestrian braking up to 45 mph under defined test procedures and conditions; those figures do not mean the system works in every environment or will prevent every crash. NHTSA’s announcement of the final rule provides the agency’s scope and testing details.

Is the requirement being delayed or repealed?

A possible compliance extension

A Unified Agenda entry for RIN 2127-AM69 lists a proposed rule to extend the compliance lead time for FMVSS No. 127 by two years and allow temporary flexibility through repeated trials for performance requirements. It lists a July 2026 NPRM date and identifies the item as being at the proposed-rule stage. A Unified Agenda date is a planning entry, not proof that a proposal was published or finalized. The entry therefore does not itself change the September 2029 deadline. The Unified Agenda record describes the planned action.

A separate bumper-sensor question

Another agenda item, RIN 2127-AN02, concerns a possible exemption from bumper requirements for vehicles equipped with AEB and crash-avoidance sensors. Its stated purpose is to accommodate the sensors and promote advanced safety technology; it is not a proposal to eliminate AEB. The separate agenda record addresses bumper requirements.

Automated-vehicle brake controls are a different issue

NHTSA’s June 25, 2026 announcement concerns a proposed change to manual brake-pedal requirements for vehicles designed to be driven exclusively by automated driving systems. The announcement says stopping-distance criteria would remain. That proposal concerns manual controls on a distinct category of vehicle, not the AEB standard for ordinary passenger cars and light trucks. NHTSA’s announcement describes that separate issue.

What is known about AEB’s benefits and trade-offs

When NHTSA finalized the rule in 2024, it projected that the standard would save at least 360 lives and prevent at least 24,000 injuries annually. These are the agency’s projections published with the final rule, not measured results after nationwide implementation. In announcing the rule, NHTSA Deputy Administrator Sophie Shulman said the agency considered AEB mature enough to require in new cars and light trucks; that statement represents NHTSA’s position at the time, not a guarantee of performance in every crash or condition.

A fair debate weighs the expected reduction in crashes and injuries against vehicle purchase costs, system performance in different speeds and conditions, false activations and driver trust, and the time and flexibility manufacturers receive to meet the standard. The federal rule specifies tests and false-activation provisions, while the reported political debate raises cost and performance concerns. The cited reporting does not quantify how much AEB adds to vehicle prices or independently establish how the systems perform across all real-world conditions, so neither point should be treated as settled by the hearing report.
