The key federal benchmark in the National Highway Traffic Safety Administration’s interpretation of FMVSS No. 205 is at least 70% light transmittance in glazing areas needed for driving visibility. A film’s own advertised rating does not prove that the film and your existing windshield will meet that threshold together.
Why tinting the front windshield is a poor default
The windshield is a primary area for seeing the road, signs, pedestrians and other vehicles. Applying film changes how much light passes through it. Because the final result depends on the film together with the factory glass, a product labeled as highly transparent can still leave the finished windshield below the applicable threshold.
NHTSA’s interpretation explains that the 70% light-transmittance requirement applies to the glazing with the added film installed—not just to the film on its own. The agency’s interpretation is available at NHTSA’s 7685 interpretation.
What the federal 70% rule says
In a May 10, 2011 interpretation of Federal Motor Vehicle Safety Standard No. 205, NHTSA says glazing in areas requisite for driving visibility must have at least 70% light transmittance. This is a regulatory threshold, not a statistic about crash outcomes. The interpretation also discusses the AS-1 marking and the limited shade-band allowance at the top of a windshield. The visibility area
For the area needed for driving visibility, the cited interpretation describes a minimum of 70% light transmittance. Do not assume that a film’s separate rating establishes the finished glass’s transmittance; the combined film-and-windshield result is what matters under the interpretation.
The top shade band and AS-1 line
NHTSA distinguishes the visibility area from a top shade band. Its interpretation says FMVSS No. 205 does not restrict tinting or opaque obstructions in the shade-band area when the windshield meets the other applicable performance requirements. It describes the AS-1 marking as identifying the portion meeting the applicable transmittance threshold in that arrangement. Without an AS-1 line, the interpretation says the windshield must meet at least 70% transmittance throughout; a top shade band is described as permissible if it remains at or above that threshold.

This is a limited allowance, not permission to put any tint anywhere on a windshield. The interpretation concerns federal glazing requirements and does not establish that a particular installation is legal to use on the road in every state.
Federal glazing rules are not the whole state-law answer
Federal vehicle-glazing requirements and state rules for operating or inspecting a vehicle are distinct questions. NHTSA’s interpretation discusses federal requirements and their interaction with state regulation, but the official sources cited here do not provide a current state-by-state survey. Check the current statute, inspection rules or motor-vehicle agency guidance for every jurisdiction where you drive. NHTSA discusses the federal-and-state distinction in its 1985-03.3 interpretation.

Who may install film—and what to check first
NHTSA says a manufacturer, distributor, dealer or repair business may not knowingly make inoperative compliance with an applicable glazing standard through an installation. That restriction is tied to the businesses and context described by the agency; it should not be read as a complete statement of every vehicle owner’s obligations or every state’s operating rules. The agency’s interpretation on glazing with film installed explains the combined-transmittance issue and the make-inoperative restriction.

- Identify the exact area where film would go: the driving-visibility area or the limited top shade-band area.
- Ask for evidence about the transmittance of the finished film-and-glass combination, rather than relying only on the film’s advertised rating.
- Verify current state operating and inspection requirements for the places where you drive.
- If compliance is uncertain, do not install film across the windshield.
