The U.S. Trustee was the principal objector to Fisker’s proposed sale of Ocean SUVs to American Lease. The Trustee questioned whether Fisker had adequately marketed the vehicles, contacted other buyers or established their value, and criticized the rushed timetable. Fisker’s dealer partner Ideal Motors separately objected over notice and timing, while the official committee of unsecured creditors supported the deal.
What Fisker proposed to sell
Fisker sought approval to sell substantially all of its vehicle inventory to American Lease. A July 2024 court filing described a maximum potential price of $46.25 million. That figure was a proposed ceiling, not a verified final payment or a court finding that the vehicles were worth that amount. The court filing described the value dispute.
Fisker said the transaction would bring in cash to keep its Chapter 11 case operating while creditors disputed the remaining estate. The dispute was therefore about both the sale process and the debtor’s stated need for near-term liquidity.
Why the U.S. Trustee objected
The Trustee’s challenge focused on whether the process could show that the estate was getting the best available value. The Trustee said the record did not provide enough information about marketing, outreach to other potential buyers or vehicle valuation, and argued that the proposed price and compressed schedule did not demonstrate adequate value maximization. TechCrunch’s contemporaneous report described the objection.

Lawyers for the Trustee’s office criticized the timetable and the apparent lack of a broader buyer search. As reported by TechCrunch, they wrote: “Fisker ‘sought a sale hearing for their ‘crown jewel’ assets on one week’s notice over a federal holiday and are exclusively pursuing a private sale to one buyer without any efforts to notify other potential purchases,’ lawyers for the Trustee’s office wrote.” That was the Trustee’s argument, not a judicial finding.
How the other parties differed
| Party | Main position |
|---|---|
| U.S. Trustee | Objected to the sale process, raising concerns about marketing, outreach to other buyers, valuation and the rushed schedule. TechCrunch |
| Ideal Motors | Separately objected that it had not been properly notified and criticized the speed of the process; its objection was narrower than the Trustee’s challenge to marketing and valuation. TechCrunch |
| Official committee of unsecured creditors | Supported the deal, saying the fleet had been adequately marketed and American Lease offered the highest and best offer Fisker could secure under the circumstances. TechCrunch; court-related reporting |

What the later bankruptcy developments establish
Fisker’s October 2024 disclosure statement said the company paused EV production in March 2024 and pursued several ways to monetize inventory, including discounted sales, auctions and a fleet transaction. It also reported that roughly 6,200 Ocean vehicles had been sold globally by the petition date. These were statements by the debtor in its disclosure document, not independent findings of vehicle value. Fisker’s disclosure statement

On October 16, 2024, the bankruptcy court confirmed Fisker’s liquidation plan after hearings on October 9 and 11. The confirmation order says unresolved plan objections were overruled on the merits, subject to its stated treatment of unresolved cure amounts. That later order should not be read as a ruling on every issue raised in the earlier fleet-sale dispute. The confirmation order

The available records do not establish the exact completed sale price, delivery total or precise final disposition of every July objection. In particular, the proposed maximum of $46.25 million should not be described as the amount American Lease ultimately paid. Nor does the reported dispute establish an independent market valuation of the Ocean fleet.
