Responsibility depends on the evidence and the claims available in the specific case. Potentially responsible parties can include the passenger-service operator, a vehicle or technology manufacturer, another road user, or several parties. California’s permits regulate operation and passenger service; they do not decide civil fault.
Who could be held responsible?
The facts may point to one or more parties. The vehicle being in autonomous mode does not, by itself, prove negligence or a product defect. The California agency materials cited here explain regulation, insurance, reporting and information-sharing requirements; they do not establish a universal rule assigning civil liability to an operator or manufacturer.

| Potential party | What evidence may matter |
|---|---|
| Passenger-service operator or carrier | Who ran the service, how the trip was managed, the vehicle’s operating procedures, and whether it was operating within permitted conditions. |
| Vehicle, software or equipment manufacturer | Whether a defect or failure in the vehicle, software or equipment contributed to the collision. |
| Another road user | Whether another driver, cyclist or other road user’s conduct contributed to the crash. |
| More than one party | Trip, incident, vehicle and communications records may show several contributing causes rather than one. |
These are possible lines of inquiry, not findings about any particular collision. A real claim requires an assessment of the incident evidence and applicable law.
How California regulates robotaxis—and what permits do not decide
California divides oversight between the Department of Motor Vehicles (DMV) and the Public Utilities Commission (CPUC). The DMV regulates autonomous-vehicle testing and deployment. The CPUC regulates passenger-carrier service and its authorization. The CPUC says autonomous vehicles have been authorized for passenger service by charter-party carriers that also hold required DMV authority for testing or deployment on California roads. Its autonomous-vehicle program distinguishes test pilots from deployment programs; deployment participants may charge fares, while test-pilot rides may not be charged. A permit does not establish that a party was at fault—or free from fault—in a crash.

On April 28, 2026, the DMV announced updated AV regulations with staged permitting, a structured safety case, and new reporting and enforcement measures. Some provisions took effect immediately and others are phased in. The announcement describes permitting criteria that include 50,000 miles of light-duty or 500,000 miles of heavy-duty testing at each phase. Those are criteria reported by the DMV, not crash statistics or proof that a particular vehicle was safe in a particular incident. Check the operative rule for the crash date and service involved. What insurance applies?
The CPUC says passenger carriers must procure and maintain adequate protection against liability imposed by law, and directs carriers to the applicable General Orders for limits by carrier type. The materials cited here do not establish one minimum limit for every robotaxi operator and service configuration. For a specific claim, identify the carrier, service, permit and policy that applied to that trip. CPUC passenger-carrier and transportation guidance.

Do not assume that transportation network company (TNC) coverage automatically governs a driverless robotaxi. The CPUC’s TNC guidance concerns services connecting passengers to participating drivers using personal vehicles. It describes $1 million in primary commercial coverage during the accepted-match period and while a passenger is in the vehicle, plus $1 million in uninsured/underinsured motorist coverage while the passenger is in the vehicle. Those figures apply to the specified TNC periods, not as a universal robotaxi policy limit. CPUC TNC insurance requirements.

How to identify the operator and report a safety incident
California’s adopted AV regulation requires a driverless vehicle to be able to display or transfer owner or operator information after a crash, collision or accident. For driverless testing, the regulation also specifies a communication link for location and status, along with two-way communication in certain circumstances. This can help identify whom to contact; it does not determine civil liability. California DMV autonomous-vehicle regulations.
