If police signal you to stop in Hawaii, pull over to a safe place as soon as practical, keep your hands visible, and follow instructions calmly. When asked, show your driver’s license, vehicle registration, and proof of insurance. Hawaii allows you to display an electronic insurance card on your phone, with a statutory limit on what the officer may view on the device for that purpose. You may say that you wish to remain silent or do not consent to a search, but do not physically resist. If you receive a citation, follow the instructions printed on it.
What to do first when police signal you to stop
- Signal and choose a safe place. Move out of traffic and stop as soon as practical. If the location immediately beside you is unsafe, avoid abrupt or unpredictable maneuvers; stop at a safer place as soon as you can do so safely. The goal is to respond to the signal while avoiding a sudden move that could create a hazard.
- Make the vehicle predictable. Once stopped, turn off the engine and turn on the interior light if it is dark. Lower the window part way. These are safety recommendations from the ACLU of Hawaii, not statutory commands. (ACLU of Hawaii: Know Your Rights)
- Keep your hands visible. Place them on the steering wheel or another clearly visible spot. Avoid sudden movements. If you need to reach for a document, tell the officer what you are reaching for and move deliberately; do not reach unexpectedly into a glove compartment, bag, or pocket.
- Wait for directions. The officer may ask you or passengers to remain in the vehicle. Follow directions calmly, and ask for clarification if you do not understand what is being requested. Honolulu PD policy says officers should request that occupants remain in the vehicle for safety, but that policy applies to HPD personnel, not automatically to officers in other counties.
Honolulu Police Department policy says officers should, in most instances, direct a driver to the far right side of the roadway, using emergency equipment, hand signals, or a public-address system. It also recognizes that a driver may stop elsewhere when the requested location would create a hazard. This is policy for Honolulu officers, not a statewide driver rule or a guarantee of how officers in other counties will conduct a stop. (Honolulu Police Department: Traffic Stops)

ACLU of Hawaii guidance also recommends turning off the car, switching on the interior light at night, and opening the window part way. Treat these as practical steps intended to make the interaction more predictable, rather than as legal requirements. The broader principle is to avoid sudden movements and make it clear what you are doing.
Documents to show when asked
Hawaii’s statewide statutes distinguish the documents a driver must carry from the vehicle owner’s registration certificate. Keep them accessible, but do not reach for them until you can do so safely. The law requires display when requested; the practical advice to announce a reach first is a safety recommendation, not a separate document rule.

| Driver’s license | Hawaii Revised Statutes §286-116 requires a driver to have a valid license in immediate possession and display it on demand. | Show the requested license. If you need to retrieve it, tell the officer first and reach slowly. |
| Insurance identification | Section 286-116 requires the applicable motor-vehicle or liability-insurance identification card while driving and requires display on demand. | Show the paper card or, as described below, its electronic version. |
| Vehicle registration certificate | Section 286-47 requires the vehicle owner to keep the certificate of registration in the vehicle and present it at an officer’s request, subject to statutory exceptions. | Present it if requested. If the vehicle is not yours, explain that calmly rather than searching the vehicle without warning. |
Sources: Hawaii Revised Statutes §286-116 and Hawaii Revised Statutes §286-47.
The distinction matters if you are driving a vehicle owned by someone else: the registration-certificate obligation described in §286-47 is assigned to the vehicle owner, while the license and applicable insurance-card requirements apply to the driver. The statute includes exceptions, so this summary is not a substitute for checking the law that applies to a particular vehicle or situation. If you do not know where a requested document is, say so rather than rummaging suddenly through the vehicle.
Showing insurance proof on your phone
Hawaii law permits an electronic motor-vehicle insurance card to be displayed on a mobile electronic device. For that display, §286-116 says an officer may view only the electronic insurance card and is otherwise prohibited from viewing other content on the device. The statute also makes the person displaying the device responsible for damage to it.

To keep the exchange clear, have the insurance card ready before driving if possible. If you need to unlock or navigate your phone after stopping, say that you are opening the insurance card and keep the screen directed to it. You can calmly remind the officer that you are displaying the insurance card under §286-116. Do not hand over the phone or expose unrelated content voluntarily merely to show the card.

This phone-display rule is specific to showing the electronic insurance card; it is not a general authorization to browse or use a phone while driving. Separately, Hawaii’s mobile-device statute defines use while operating a vehicle to include holding the device. It provides an exception for a vehicle fully stopped, with the engine off, in a safe place off the roadway. Do not handle your phone while moving; stop safely before retrieving electronic proof. (Hawaii Revised Statutes §291C-137)
What Honolulu officers’ policy says to expect
HPD’s policy describes a motor-vehicle stop as based on an officer’s objectively reasonable suspicion that a person violated a statute or ordinance. It instructs officers to consider road, weather, lighting, and traffic conditions; use emergency equipment to initiate a stop; notify dispatch; approach cautiously; and request that occupants remain in the vehicle for safety. Officers should identify themselves, give the reason for the stop, and request the driver’s license, registration, insurance, and other applicable documents.
HPD states: “All traffic stops have unknown risks, and the potential for violent encounters with motor vehicle occupant(s) may occur.” That explains the department’s emphasis on caution; it does not mean every stop is dangerous or that the same policy governs other county police departments. The policy is useful context about Honolulu procedure, but it does not change the statewide statutes governing licenses, insurance proof, registration, and mobile-device use. Questions, silence, and searches
The ACLU of Hawaii’s stop guidance says drivers and passengers have the right to remain silent. You can state calmly, “I wish to remain silent.” Required document requests are separate from questions about where you are going, where you have been, or other matters. Keep your tone respectful and do not confuse declining to answer a question with refusing a safety instruction or required document request. (ACLU of Hawaii: Know Your Rights)

You may also say, “I do not consent to a search.” State the objection clearly and calmly. Refusing consent does not guarantee that an officer will not conduct a search on another asserted legal basis. If an officer proceeds, do not physically interfere or resist. Whether a particular search or detention was lawful depends on its circumstances; a general article cannot determine that for an individual stop.
It can help to separate three things: producing documents required by law when requested, responding to other questions, and consenting to a search. The research supports the right-to-remain-silent and refusal-of-consent guidance, but it does not resolve every possible instruction an officer might give or establish whether a particular search is lawful. If you object, use words rather than physical action, and seek legal advice afterward if you believe your rights were violated.
If you receive a citation or are arrested
Read the citation or summons carefully and follow its instructions, including the stated place and time to answer. Hawaii Revised Statutes §291C-164 provides that, in the ordinary traffic-arrest procedure, an authorized officer takes identifying and vehicle information and issues a written summons or citation specifying where and when to respond. The statute allows situations in which state law authorizes or directs immediate presentation before a district judge, so not every outcome follows the same process. (Hawaii Revised Statutes §291C-164)

Do not treat the citation as informal paperwork: the notice states where and when you must respond. Keep it and any related documents together, and contact the court identified on the notice if you need information about that notice or its process. For a specific citation, arrest, search, or deadline, contact that court or a Hawaii-licensed attorney. Do not assume that a general explanation resolves how a particular case will be treated.

- Keep your valid license and applicable insurance proof available; make sure the vehicle owner’s registration certificate is in the vehicle.
- If relying on electronic insurance proof, know how to display the card without exposing unrelated phone content.
- When signaled, move to a safe place as soon as practical, stop, and keep your hands visible.
- Explain document-related movements before reaching, and avoid sudden movements.
- Stay calm, state any objection to a search without physical interference, and follow the response deadlines on any citation.
There is no single script that fits every stop. The most useful preparation is knowing where your documents are, understanding how to display your insurance card, and being ready to communicate calmly. If the stop results in a legal issue, rely on the actual citation and qualified Hawaii legal advice rather than assuming that a general guide answers the details of your case.

Can I refuse to answer questions or refuse a search during a Hawaii traffic stop?
ACLU of Hawaii guidance says drivers and passengers may remain silent and may refuse consent to a search. You can state your choice calmly. Refusing consent does not guarantee that no search will occur, and you should not physically interfere if an officer proceeds. Whether a particular search was lawful depends on its circumstances.
What should I do if the officer asks me to get out or stay in the car?
Stay calm, keep your hands visible, and follow directions rather than making sudden movements. Honolulu PD policy says officers should request that occupants remain in the vehicle for safety, but it is Honolulu-specific policy, not a statewide rule for every county. Ask for clarification if you do not understand an instruction.
What happens if I am given a traffic citation in Hawaii?
Read the citation or summons and follow its stated place and time to answer. Hawaii’s ordinary traffic-arrest procedure provides for a written summons or citation with response details, although some situations call for immediate presentation before a district judge. For a particular deadline or case, contact the court named on the notice or a Hawaii-licensed attorney.
The Bottom Line
In Hawaii, respond to a stop by pulling over safely, keeping your hands visible, and calmly showing the requested license, insurance proof, and registration as applicable. You may display an electronic insurance card, and you may calmly assert silence or decline consent to a search without physically resisting. Follow the instructions and deadlines on any citation; get Hawaii-specific legal help for questions about a particular stop.
