What Happens to a Company Car When an Employee Leaves?

A UK company car usually needs to be returned under the employer’s policy, but the tax end date depends on when private availability actually stops. Here is what employees and payroll should check.

In the UK, an employee will usually need to return a company car when they leave, but the return date and process depend on their employment terms and the employer’s vehicle policy. For tax, the key date is when the car stops being available for private use—not automatically the employee’s last working day. If the former employee keeps using it, a company-car tax charge may continue for the period of continued availability.

Do you have to give your company car back when you leave?

Usually, the employer expects the employee to return the car under the employment contract, vehicle policy or another agreement. There is no universal HMRC rule that every company car must be handed back on the employee’s last working day. The employer’s arrangements determine the practical requirements, including the handover date and location, vehicle condition, and whether collection or delivery is required.

As an Amazon Associate I earn from qualifying purchases.

Nor does leaving a job automatically give an employee the right to keep or buy the car. Any option to purchase it, or any charge connected with ending a lease early, depends on the relevant agreements. Check the employment terms and vehicle policy, and ask the employer or fleet contact to confirm the arrangement in writing. HMRC guidance covers tax and employer reporting; it does not set a general right for a former employee to retain or purchase the vehicle, nor does it determine who bears a lease or return cost.

Do not assume that a vehicle can be kept simply because it is leased by the employer, or that every leaver must pay a charge. Those practical and financial questions depend on the contract, car policy and, where relevant, the employer’s fleet or lease arrangements. If there is a proposed purchase, continued-use period or early-termination cost, ask for the terms and any relevant dates in writing before agreeing to them.

When should you return the car?

Agree the handover date with the employer rather than assuming it is the last day you work. The date matters for logistics and for the tax record: HMRC’s company-car rules turn on when private availability ends. If you return the car after your employment ends, or are allowed to keep using it for a period, tell payroll so it can account for the actual end of availability.

There are two dates to keep distinct: the date your employment ends and the date you can no longer use the car privately. They may be the same, but that is not automatic. For example, if you are permitted to use the vehicle after your final working day, its continued availability is relevant to the tax treatment. Conversely, the car may be returned before employment formally ends. Ask the employer to identify the date it will record as the end of private availability, not only the employment leaving date.

Arrange a clear handover

  1. Ask for written return instructions. Confirm the deadline, return location and whether the employer will collect the car or expects you to deliver it.
  2. Check what must be handed over. Ask whether to return keys, vehicle documents, fuel or charging cards, and any other equipment supplied with the car. These are practical checks; they are not a universal HMRC handover list.
  3. Record the handover. Keep confirmation of when the car was returned and when it ceased to be available for private use. If fuel for private journeys was provided, clarify when that provision ends too.
  4. Keep your own tax records under review. Check your final payslip and personal tax details. HMRC says employees can check or update company-car tax details, including when they give a car back.

These steps help establish the facts if the employer’s record and your own understanding differ later. Keep the written return instructions, handover confirmation and any agreement allowing use after employment. If collection or delivery is arranged, confirm the date the car will actually cease to be available to you for private use; the administrative arrangement alone may not answer that question.

When does company-car tax stop?

Company-car tax is linked to private use or availability, rather than simply to whether the employee still works for the company. HMRC counts commuting as private use, as well as other private journeys by the employee or their family. Consequently, the date employment ends and the date the car stops being available for private use can differ.

If the car is returned and private availability ends on or before the leaving date, the employer should report that change. If the employee retains access to the car after leaving, the tax position may continue for that later period. HMRC’s Employment Income Manual (EIM23700, updated 11 September 2026) expressly covers an employer allowing a former employee to continue using a provided car without transferring ownership. The fact that the employment has ended does not, on its own, establish that the car benefit has ended.

HMRC’s manual says that where an employer allows an ex-employee to continue using a provided car, the car benefit charge is reduced on a time basis to the date of cessation. The practical point is that the end of employment and the end of car availability are separate events for this purpose. If you are allowed to keep using the car, ask the employer how long permission lasts and how payroll will treat that period; do not assume that the benefit stops on your final day at work.

Car availability and fuel for private journeys should also be clarified separately. If the car is no longer available but fuel for private journeys remains provided, confirm with the employer when that provision ends. A clear record of both dates helps the employer report the change correctly and helps you check your tax details.

Situation What matters What to check
Car returned and private availability ends by the leaving date The actual date private use or availability stops. Ask payroll to ensure the change is recorded; retain handover confirmation.
Car returned after the leaving date, or use continues The later date when private availability actually ends, including any period the former employee may use the car. Ask payroll how the continued period will be treated and taxed.
Car access ends but fuel for private journeys is still provided Whether a separate fuel benefit remains available. Confirm with the employer when private fuel provision ends as well as when the car is withdrawn.

The employer’s policy and contract determine whether a former employee may keep using the vehicle; HMRC guidance explains the tax treatment, not a right to retain it. If permission is given, ask for its end date and tax treatment in writing.

What must the employer report to HMRC?

When an employer stops providing a car for private use, it must tell HMRC using an applicable reporting route: the P46(Car) form, HMRC’s online service, or payroll software. HMRC’s employer guidance lists stopping a company car as a reason to send a P46(Car). The reporting deadline depends on when the change occurs and, for the final quarter, whether the employer reports electronically or on paper.

The applicable quarter-based deadlines are:

Date the car benefit changes Electronic reporting deadline Printed form deadline
6 April to 5 July 2 August 2 August
6 July to 5 October 2 November 2 November
6 October to 5 January 2 February 2 February
6 January to 5 April 5 April 3 May

These are HMRC’s quarter-based deadlines for reporting a change in car provision. The employer should verify the relevant deadline and route against current HMRC guidance when making the report. The reporting obligation belongs to the employer; employees should nevertheless check that their own tax details reflect the car’s actual availability.

For an employee, the key questions to ask are whether the employer has treated the car as withdrawn, what end-of-availability date it recorded and which reporting route it uses. The employer may report the change through one of the listed routes, so the employee does not complete the employer’s reporting step themselves. Checking your own tax details remains useful, particularly if those details still show a company car after it has been returned.

What happens to the car benefit on your final payslip?

The payroll treatment depends partly on whether the employer taxes benefits through payroll. HMRC says an employee leaving is a change that requires the employer to recalculate the taxable amount for payrolled benefits. If the final pay has already been made, the remaining amount cannot be put through that final payroll; payroll must handle any residual reporting and tax using the applicable HMRC process.

The employer also reports the employee’s leaving date through payroll and provides a P45 under HMRC’s leaver guidance. The car-benefit change and the employment-leaver process are related, but they are distinct reporting matters. If the final payslip does not make clear how the benefit was handled, ask payroll which route it used and what date it recorded as the end of car availability.

Do not treat the P45 as confirmation by itself that the company-car record has been ended. The leaving date is part of the ordinary leaver process, while the car change is tied to when private availability stops. If final pay was already processed before the car benefit was recalculated, HMRC says the remaining amount cannot be put through that final payroll; payroll should use the applicable process for the residual reporting and tax. Ask payroll to explain any outstanding adjustment rather than assuming it will appear on a particular payslip.

What should you do if your tax details still show the car?

If the car has been returned and is no longer available for private use, but your personal tax details continue to show a company-car benefit, first confirm the recorded end date with your former employer’s payroll or fleet contact. Check your HMRC tax details and update them or contact HMRC if the record needs correcting. Keep the return confirmation and any written agreement about continued use or fuel provision, so you can identify the date that needs checking.

When you check the record, compare it with the handover date and any later date on which you were allowed to use the car privately. If there was continued use, the relevant end date may be later than your employment leaving date. If your details do not reflect the facts after you have checked with the employer, HMRC says employees can check or update company-car tax details, including when they give a car back. Retain the employer’s response and your handover confirmation in case you need to explain the discrepancy.

What employers and payroll teams should coordinate

  • Confirm the employee’s final date of private availability, which may not be the same as the leaving date.
  • Record separately any agreed post-employment use and the date it ends.
  • Confirm when any fuel for private journeys stops being provided, rather than assuming that date is identical to the car handover.
  • Recalculate the taxable amount if the benefit is payrolled, and follow the applicable process for any residual amount if final pay has already been processed.
  • Report the stopped car provision through an applicable HMRC route by the deadline for the date of change.
  • Complete the ordinary leaver payroll process, including reporting the leaving date and issuing a P45.
  • Give the employee clear written instructions about the practical return arrangements and confirmation of the dates recorded.

These actions keep three matters distinct: returning the vehicle under the employer’s arrangements, reporting the end of private availability for company-car purposes, and completing the normal employment-leaver payroll steps. The actual dates and process should be checked against the employment terms, vehicle policy and current HMRC guidance.

Frequently Asked Questions

Do I have to give my company car back when I leave?

Usually, you return it under your employment terms, vehicle policy or another agreement. There is no universal HMRC rule requiring every car to be handed back on the last working day. Ask your employer or fleet contact for written instructions and check whether there is any agreed purchase or continued-use option.

When do I return my company car after leaving?

Agree the handover date with your employer; do not assume it must be your last working day. The employer’s arrangements determine the practical return date and location. For tax, the important date is when the car stops being available for private use, so keep confirmation of the handover and any later permitted use.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Will I still pay company-car tax after I leave?

Possibly, if the car remains available for your private use after your employment ends. HMRC’s Employment Income Manual covers former employees who continue using an employer-provided car without taking ownership. Ask payroll to confirm the recorded end-of-availability date and how any continued-use period will be treated.

What happens to my company-car benefit on my final payslip?

If the benefit is taxed through payroll, HMRC says an employee leaving is a change requiring the taxable amount to be recalculated. If final pay has already been made, the remaining amount cannot be put through that final payroll; payroll must use the applicable process for residual reporting and tax. Ask payroll how it handled the car benefit.

Can I keep my company car after leaving my job?

Only if the employer’s arrangements allow it. HMRC’s tax guidance does not create a right to retain or buy the vehicle. Ask the employer for any continued-use or purchase terms in writing, including the period of use. If you continue using it privately, a car-benefit charge may continue for that period.

What if my HMRC tax details still show a car I returned?

Confirm the end-of-availability date recorded by your former employer, then check your HMRC tax details. You can update company-car details or contact HMRC if they need correcting. Keep your handover confirmation and any written record of continued use or fuel provision so you can check the relevant dates.

The Bottom Line

Return arrangements come from your employer’s terms and vehicle policy, not a universal rule that every car must be returned on the last working day. For tax, what matters is when private availability actually ends, including any agreed post-employment use. Confirm the dates with payroll, keep evidence of the handover, and check your HMRC tax details if they still show a car you no longer have available.
