Trump’s War on Electric Cars: What Has Changed and What Remains Unsettled

Federal EV tax credits have ended for later acquisitions, EPA repealed vehicle greenhouse-gas standards, and California rules face federal challenges. Here is what those changes do—and do not—mean.

Trump’s administration has rolled back federal support for electric vehicles and challenged rules that encouraged a shift away from gasoline vehicles—but it has not banned Americans from buying EVs. The clean-vehicle tax credits ended for vehicles acquired after September 30, 2025; Congress and the President disapproved three California waiver rules in June 2025; and EPA finalized a repeal of federal vehicle greenhouse-gas standards in February 2026. A Justice Department lawsuit against California, filed in March 2026, is a separate legal challenge whose later status is not established by the available announcements.

What does the administration mean by “the EV mandate”?

“EV mandate” is the Trump administration’s political label, not a description of a federal law requiring every driver to buy an electric car. In a January 20, 2025 executive order, Unleashing American Energy, President Donald Trump directed agencies to pursue what the order called eliminating the “electric vehicle (EV) mandate” and to review vehicle rules, state waivers and subsidies.

The actions that followed targeted several different policy tools: federal tax credits, EPA greenhouse-gas standards, and California rules that had been allowed under federal Clean Air Act waivers. They affect incentives and regulatory requirements; they do not make owning or purchasing an EV illegal.

Which California rules did Congress and the President target?

On June 12, 2025, the President signed H.J. Res. 87, 88 and 89, disapproving waivers for three California programs: Advanced Clean Trucks, Advanced Clean Cars II, and the Heavy-Duty Low NOx Omnibus regulation. The Clean Air Act waiver process had allowed California to set certain vehicle-emissions rules more stringent than federal requirements, with other states able to adopt California standards.

Advanced Clean Cars II

The White House’s April 2026 Economic Report of the President describes Advanced Clean Cars II as requiring new passenger vehicles sold in California to be zero-emission by 2035. That is a description of the rule’s intended trajectory, not a statement that all vehicles on California roads would have had to be electric by then.

Advanced Clean Trucks and the Heavy-Duty Low NOx Omnibus rule

These were separate rules addressing trucks: Advanced Clean Trucks concerned the transition of new truck sales toward zero-emission vehicles, while the Omnibus regulation set heavy-duty nitrogen-oxide pollution requirements. The June resolutions disapproved the waivers associated with these rules as well as the passenger-car waiver. They were not three versions of a single nationwide EV sales ban.

In his June 12 statement, Trump argued that federal rather than state authorities should set vehicle emissions standards, saying a state “patchwork” was unworkable. The President also asserted that the targeted programs were preempted and could not be implemented, and that substantially similar waivers could not be approved. Those are the administration’s legal positions; the statement alone does not establish an uncontested resolution of every dispute over California’s authority.

What happened to federal vehicle-emissions standards?

EPA announced reconsideration of vehicle greenhouse-gas rules on March 12, 2025, including standards for model-year 2027-and-later light- and medium-duty vehicles and heavy-duty vehicles. Administrator Lee Zeldin characterized the rules as imposing heavy costs on the auto industry and described the effort as a way to protect consumer choice and the environment. EPA’s claim in 2025 that the rules carried more than $700 billion in regulatory and compliance costs was an agency estimate, not a measured amount of savings.

On February 12, 2026, EPA finalized a broader action: rescinding the 2009 Endangerment Finding and repealing subsequent federal greenhouse-gas standards for highway vehicles and engines under the Clean Air Act. EPA says the action does not affect traditional air-pollutant standards. Its final-rule summary projects more than $1.3 trillion in vehicle-cost savings; that is EPA’s forecast, not a tally of savings already received by households.

The practical policy change is to the federal greenhouse-gas rules governing vehicles and engines, not to the legality of electric cars. The sources cited here do not establish what the repeal has done to vehicle prices, sales, jobs, investment or emissions.

When did federal clean-vehicle tax credits end?

Under Public Law 119-21, the IRS says the new-vehicle clean-vehicle credit (Section 30D), used-vehicle credit (Section 25E), and commercial clean-vehicle credit (Section 45W) do not apply to vehicles acquired after September 30, 2025. For a qualifying vehicle, a written binding contract and payment by that date may count as acquisition even if delivery occurs later; eligibility requirements still apply. This means the cutoff is not simply the date a car is delivered.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The IRS also gives charging-property credit a separate deadline: qualifying property had to be placed in service by June 30, 2026. That deadline has passed as of October 4, 2026. This is distinct from the vehicle-credit acquisition cutoff, and the two dates should not be confused.

Ending these credits removes a federal financial incentive for qualifying purchases; it does not prevent a person or business from buying an EV. IRS guidance notes that vehicles acquired by the applicable deadline may still qualify when placed in service later if the other requirements are met.

What is the Justice Department’s California lawsuit about?

On March 12, 2026, the Justice Department announced that it had filed a case on behalf of NHTSA against the California Air Resources Board and its executive officer in the U.S. District Court for the Eastern District of California. DOJ alleges that California’s vehicle standards are preempted by federal fuel-economy law.

This lawsuit is distinct from the June 2025 congressional resolutions disapproving waiver rules: one is a court case challenging California standards, while the other was a set of legislative actions concerning specific waivers. DOJ’s announcement confirms that the suit was filed, but does not establish a later ruling or the case’s current procedural status. It should not be described as a court victory for either side.

What has—and has not—been established about the effects?

The policy actions and announcements above are documented. Their market consequences are a different question. EPA’s $700 billion cost figure and its later projection of more than $1.3 trillion in savings are estimates or claims by the agency, not independently measured outcomes in the sources cited here.

  • Established: federal clean-vehicle tax credits have acquisition cutoffs; three California waiver rules were disapproved; EPA finalized repeal of federal vehicle greenhouse-gas standards; and DOJ announced a lawsuit against California.
  • Not established here: the resulting change in EV sales, vehicle prices, employment, investment, emissions, or household costs, or the later outcome of the California lawsuit.
