President Donald Trump’s October 5, 2026, executive order does not automatically erase diesel taxes or guarantee cheaper fuel for contractors. It directs Treasury to determine whether federal tax-payment deferrals are legally available, and separately directs Treasury to have the IRS announce specified penalty relief for highway use of dyed diesel through December 31, 2026. The practical terms depend on Treasury and IRS guidance, state rules and whether a fuel stop can serve a contractor’s vehicle.
What the October 5 order actually does
The order, “Emergency Tax Relief on Diesel Fuel”, sets out two distinct forms of potential relief for qualifying fuel during October 5 through December 31, 2026: a conditional deferral of certain federal fuel-tax payments and specified relief from penalties tied to dyed diesel used on highways.

Tax-payment deferral is conditional, not automatic
The order directs Treasury, within five days, to determine whether relief is authorized under 26 U.S.C. 7508A, including whether a qualifying event occurred and which taxpayers were affected. If Treasury makes the required determinations, it is directed, to the extent authorized by law, to defer specified fuel-tax payments on qualifying fuel incurred during the relief period.
Deferred amounts are to be deferred without penalties, interest or additions to tax. But deferral is not forgiveness: the order directs Treasury to explore options, including legislation, to eliminate the repayment obligation. That exploration is separate from the order’s deferral direction; the order itself does not cancel the taxes.

Penalty relief is a separate instruction
The order tells Treasury to direct the IRS to announce that it will not impose specified penalties when dyed diesel is sold for highway use or used on highways during the same period. The announcement is also to address penalties for failure to make semimonthly deposits. This does not mean every tax, penalty or compliance obligation disappears. Treasury’s implementing guidance must identify the legal basis, covered taxpayers and persons, locations, acts, liabilities, deadlines, periods and the date postponed taxes must be paid.
Enforcement continues
The order calls for Treasury to assess how the IRS should allocate resources to vehicle fuel-tank inspections and fuel sampling during any relief period, and to publicly announce its determination. It also directs the Transportation Department to coordinate with states, industry and labor while continuing compliance measures required by law. Agriculture is directed to coordinate with cooperatives and rural distributors on distribution in high-demand areas and to encourage corresponding state action.

What dyed diesel relief could mean for contractors
Dyed diesel is intended for off-road uses, including construction and agriculture. The dye identifies fuel intended for those uses; the order addresses temporary highway use and related federal tax and penalty treatment. It is not a diesel-price cap, a guarantee of savings or a promise that every fueling station will sell dyed fuel to highway vehicles.
Local contractors and interstate carriers face different logistics
A contractor working within one state may have fewer jurisdictions to check than an interstate carrier crossing several states. State tax rules, enforcement and any state response can affect the practical outcome. The federal order does not establish a universal state-by-state permission, so drivers should not assume the same treatment applies along an entire route.

Fuel access is another constraint. The Associated Press reported concerns that some dyed-diesel pump stations are not configured to serve semis, and that interstate truckers may have to navigate a patchwork of state rules. A legal change does not help a driver who cannot find a location that can safely and practically fuel the vehicle.
Farm operators may see a smaller or situational benefit
Farmers already use dyed diesel for off-road work, so the incremental benefit may be limited for operators who have finished harvest or do not haul products on public roads. Farms still transporting crops or other goods by road may have a different exposure. The distinction is between off-road use and highway use—not simply between farming and trucking.

How much could contractors save?
The White House fact sheet presents savings and affordability claims, but those are administration claims rather than verified outcomes. At the signing, Trump said, “The typical trucker will save more than $100 every time they fill up,” as reported by the Associated Press. That is a political claim, not a measured or guaranteed saving for an individual operator.
In its October 7, 2026, report, the AP cited AAA’s national diesel average of $6.30 per gallon on the Wednesday before publication, more than 70% above a year earlier. That is a dated national snapshot, not a current quote or a forecast. North Dakota Farmers Union president Matt Perdue told the AP diesel was “over two dollars more than they were last year” and said the order “just doesn’t come close to closing that wound.”

The AP also quoted Patrick De Haan, head of petroleum analysis at GasBuddy: “The largest diesel users are the least likely to use dyed diesel.” Todd Spencer, president and CEO of the Owner-Operator Independent Drivers Association, estimated to the AP that each $1-per-gallon increase costs an independent trucker about $400 more per week. That is Spencer’s estimate, not an audited average. The AP reported that independent truckers may feel only a small benefit, and that the American Trucking Associations would review IRS guidance when available.
What to verify before using dyed diesel on a highway
The order sets a federal framework but leaves key operating details to official guidance and, in practice, state and fuel-provider conditions. Before relying on the order for a vehicle or route, check:
- Federal guidance: Look for Treasury and IRS terms defining covered taxpayers, fuel, transactions, locations, deadlines and any deferred-tax payment date.
- State treatment: Confirm current rules and any state action for every state on the route; do not assume federal instructions settle all state-level tax or enforcement questions.
- Fuel-site capability: Call the supplier to verify that the location carries dyed diesel and can serve the vehicle, particularly a large truck or tractor-trailer.
- Use and records: Follow the conditions in applicable official guidance and retain fuel, vehicle and route records needed to establish what fuel was used and when.
- Repayment exposure: Treat a tax deferral as postponed payment unless a later legal change explicitly eliminates the obligation.
