The SEC closed its investigation into Fisker in September 2025, according to a February 2026 report by TechCrunch, which cited an SEC FOIA response and a follow-up email from the agency. The SEC has not publicly explained what the investigation found or why it closed. The closure is not, by itself, evidence that Fisker was cleared or that it violated securities laws.
What is known about the SEC investigation
The clearest public account of the closure comes from TechCrunch, which reported on February 13, 2026, that the SEC’s FOIA office told the outlet the investigation “was closed in September 2025.” The report says the agency provided the information in a January 2026 FOIA response and a follow-up email. The SEC spokesperson declined to comment; that is not a statement about the investigation’s findings.
The SEC had disclosed that the investigation was still pending in a court filing dated October 4, 2024. In an objection filed in Fisker’s Chapter 11 bankruptcy case, the agency asked the court to preserve its regulatory powers, access to company records, and ability to bring possible future federal securities-law actions. It said it had outstanding investigative subpoenas and might seek additional documents. The filing establishes the investigation’s status at that time, not its eventual outcome. Why did the SEC close its investigation into Fisker?
The public material cited in the closure report does not establish why the SEC closed the matter, what evidence it gathered, or how far the investigation progressed. It also does not establish whether the agency reached conclusions or considered or recommended enforcement. The SEC’s investigative file and a final investigative report or formal closure notice are not included in the sources cited here.

TechCrunch reported that the SEC FOIA office identified “approximately 21.7 gigabytes of electronically maintained records” related to the investigation. That figure describes the volume of responsive records, not the evidence’s strength, whether wrongdoing occurred, or the investigation’s progress.
Did the SEC find wrongdoing, or was Fisker cleared?
Neither conclusion is supported by the reported closure. The SEC has not publicly stated that Fisker or any individual violated securities laws, and the closure alone does not amount to a formal exoneration. Without a public explanation from the agency, readers cannot infer from the closure whether the SEC found a violation, found no violation, or closed the matter for another reason.

How the SEC investigation relates to Fisker’s bankruptcy
Fisker filed for Chapter 11 bankruptcy in June 2024, before the SEC’s October 2024 objection and roughly a year before the reported closure. The objection concerned protecting the SEC’s powers in a pending investigation and preserving access to corporate records through the bankruptcy process. It does not disclose the investigation’s final findings.
Do not confuse the SEC matter with NHTSA’s safety evaluation
The SEC investigation concerned securities regulation. Separately, the National Highway Traffic Safety Administration (NHTSA) closed a preliminary evaluation of alleged inadvertent automatic emergency braking in 2023 Fisker Ocean vehicles on January 16, 2025. NHTSA closed that safety evaluation without manufacturer action but expressly cautioned that closure was not a finding that no safety-related defect existed. The reported closure does not establish that shareholders will receive money or that the bankruptcy’s outcome has changed. The public accounts cited here provide no finding, recovery estimate, or shareholder distribution tied to the SEC investigation. A regulatory investigation’s closure and any recovery through bankruptcy are distinct questions.
