The National Highway Traffic Safety Administration (NHTSA) is beginning a negotiated rulemaking effort to update Federal Motor Vehicle Safety Standard No. 108, the U.S. vehicle-lighting standard. In negotiated rulemaking, stakeholders work through a committee process to help develop a proposal. NHTSA said the Transportation Secretary may appoint up to 18 stakeholders from vehicle-lighting manufacturers, motor vehicle equipment associations, safety organizations, research institutions, and engineering associations. NHTSA Administrator Jonathan Morrison said the agency sees current standards as limiting automakers’ ability to deploy newer lighting technologies and wants the process to address potential causes of glare. What parts of the headlight rules are under review?
NHTSA identified five areas for examination. They are subjects for discussion, not settled changes:
- Glare: How rules can address glare from modern headlighting.
- Lighting technologies and sources: How the standard treats LEDs, dusk sensors, automatic high beams, and replaceable light sources.
- Headlamp height and aim: How a lamp’s position and direction affect visibility.
- Optics testing and materials: Testing for plastic optics and replaceable lenses.
- International alignment: Whether and how U.S. rules should be aligned with international safety standards.

What is the difference between automatic high beams and adaptive driving beams?
Conventional automatic high-beam assistance switches between high and low beams. Adaptive driving beam (ADB) systems can instead shape the beam dynamically, reducing light directed toward occupied areas while illuminating more of the unoccupied road. NHTSA describes ADB’s purpose as improving distance illumination of pedestrians, animals, and objects while limiting glare toward other drivers. NHTSA’s ADB rule

That intended benefit depends on the system correctly detecting other vehicles and shading them. ADB is not proof that all headlights—or every system in operation—eliminate glare. NHTSA’s ADB rule

Were adaptive driving beam headlights already allowed?
Yes. In 2022, NHTSA amended FMVSS No. 108 to permit manufacturers to certify ADB headlamps for vehicles sold in the United States, subject to performance requirements intended to ensure safe operation. The amendment allowed manufacturers to offer ADB; it did not require them to install it. NHTSA’s 2022 rule
NHTSA denied all petitions it received seeking reconsideration of that 2022 rule in 2024. That completed action concerns the earlier ADB amendment. It is separate from the broader standards process announced in 2026. NHTSA’s 2024 response

What happens next, and what can the public do?
NHTSA invited comments on the process’s scope and committee membership, as well as formal nominations for committee membership. The deadline stated in its announcement is November 9, 2026. For drivers, the practical point is that existing rules remain distinct from a future outcome of this process. NHTSA has not announced a new glare limit, required ADB, or committed to a specific international standard. Until the agency publishes further rulemaking, the five announced topics are an agenda—not changes to follow when buying or using a vehicle.
