Yes, Tesla’s robotaxi ambitions are part of a real federal safety inquiry—but the details matter. The National Highway Traffic Safety Administration’s Office of Defects Investigation opened Preliminary Evaluation PE24031 on October 17, 2024, to examine Tesla vehicles using Full Self-Driving (FSD) after four reported crashes in reduced-visibility conditions. One crash involved a fatal pedestrian strike.

On May 8, 2025, NHTSA asked Tesla how technology derived from FSD would be evaluated and operated for robotaxi service. That was not a separate announcement that Tesla’s robotaxi system had been found unsafe or unlawful. It was an information request made within the existing FSD investigation.

What NHTSA is investigating

PE24031 concerns Tesla vehicles equipped with FSD and their performance when visibility is impaired by sun glare, fog, or airborne dust. NHTSA identified four crash reports submitted under its Standing General Order, including one fatal pedestrian crash and another involving a reported injury.

  • Whether FSD’s engineering controls properly account for reduced visibility.
  • Whether other similar crashes occurred.
  • Whether Tesla software updates changed system performance.
  • Whether drivers understood the system’s limitations and their continuing responsibility.

The opening document identifies reported circumstances; it does not establish that FSD caused the crashes. A preliminary evaluation is an investigative step, not a final defect finding, recall order, or determination that Tesla violated the law.

Why robotaxis became part of the inquiry

Tesla’s public plans raised the stakes because the company described a future automated-driving service based on technology derived from FSD Supervised. In its May 2025 letter, NHTSA referred to Tesla’s plans to operate Model Y robotaxis on public roads in Austin, Texas, beginning in June 2025, potentially charging passengers and later expanding to other cities.

NHTSA wanted information about how Tesla would address reduced visibility when that technology was used for robotaxi operations. The letter did not announce a separate “robotaxi investigation.” Instead, it expanded the information being collected as part of PE24031.

The agency requested information covering areas such as:

  • The technology stack intended for robotaxi operation.
  • The system’s operating design domain, including geographic and weather limits.
  • Public-road testing, validation, and safety-evaluation methods.
  • How the vehicles would respond to glare, fog, dust, and other visibility problems.
  • Fleet size, vehicle configuration, and deployment plans.
  • Remote assistance and human intervention procedures.
  • Software updates that could alter system behavior.
  • Crash, incident, and performance data.

Receiving an information request does not mean Tesla’s answers proved the system was safe. It means the regulator considered the information relevant to its safety review.

Read NHTSA’s May 8, 2025 information request.

FSD Supervised is not the same as a driverless robotaxi

This is the most important distinction in the story.

FSD Supervised is a driver-assistance system. The human driver must remain attentive, monitor the vehicle, and be ready to take over. Removing that driver fallback changes the safety problem substantially.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A robotaxi intended to drive without an onboard safety driver must perform the driving task within a defined operating domain without active human supervision from the vehicle. Remote assistance may help with unusual situations, but it is not automatically equivalent to a human driver continuously watching the road.

NHTSA describes Level 2 advanced driver-assistance systems as requiring a fully engaged human driver. Higher-level automated-driving systems are designed to perform the driving task within specified conditions without driver involvement. Calling FSD “self-driving” without explaining its supervision requirement can therefore mislead readers.

NHTSA’s crash-reporting guidance explains these system categories.

What Tesla says about its robotaxi rollout

Tesla’s filings describe robotaxi as part of a broader strategy involving artificial intelligence, software revenue, fleet operations, and transportation services. Tesla says it launched a Robotaxi service in June 2025 using Model Y vehicles and plans eventually to add the purpose-built Cybercab.

When evaluating any Tesla rollout announcement, readers should ask:

  • Is a safety driver present?
  • Is the service limited to a geofenced area?
  • What weather and visibility conditions are allowed?
  • Is remote assistance advisory, or can it directly control the vehicle?
  • What state and local permits apply?
  • How are crashes, near misses, and disengagements reported?

Tesla’s 2025 annual filing also says the company receives requests, subpoenas, and inquiries from agencies including NHTSA, the NTSB, the SEC, and the Department of Justice. The filing does not establish that each agency was investigating robotaxis specifically. Tesla said that, to its knowledge, no government agency in an ongoing investigation had concluded wrongdoing.

Why NHTSA crash data require caution

NHTSA’s Standing General Order requires identified manufacturers and operators to report qualifying crashes involving automated-driving systems and Level 2 driver-assistance systems. The reports help NHTSA identify patterns and decide whether further investigation or enforcement may be necessary.

Raw report totals are not reliable safety rankings. Manufacturers differ in fleet size, vehicle miles, telemetry access, crash-detection systems, reporting practices, and knowledge of incidents involving privately owned vehicles. Reports may also contain duplicate records or differing classifications.

A high number can reflect broader visibility into a fleet, while a low number can reflect limited reporting. A small, geofenced pilot also cannot automatically be compared with a large consumer fleet operating nationwide.

The practical failure modes regulators must consider

Reduced visibility is only one concern. A driverless service must also cope with:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Sun glare obscuring pedestrians, lane markings, or traffic signals.
  • Fog and dust degrading camera visibility.
  • Ambiguous road geometry and sudden lane changes.
  • Unprotected turns and incorrect stopping locations.
  • Road closures, police directions, and unusual construction zones.
  • Passengers who do not know what to do during a roadside failure.
  • Software updates that change behavior after earlier validation.
  • Conflicts with police, firefighters, ambulances, or other first responders.

NHTSA specifically warned automated-vehicle developers in 2026 that a driverless vehicle unable to interact safely with law enforcement and emergency responders can create serious danger.

Read NHTSA’s first-responder warning.

Federal oversight is different from a state operating permit

NHTSA handles federal vehicle-safety defects, crash reporting, investigations, recalls, and compliance with Federal Motor Vehicle Safety Standards. State regulators generally address operating permits, insurance, licensing, and deployment conditions. Local governments may control curb access, traffic restrictions, and municipal operating requirements. The SEC and DOJ have different jurisdiction and would require separate evidence for securities, disclosure, consumer, or criminal claims.

That division matters in Las Vegas. By July 27, 2026, Nevada regulators had granted Tesla a robotaxi permit capped at 10 vehicles, even though Tesla had sought authorization for 5,000. The permit illustrates the difference between permission to run a limited service and approval to scale a nationwide driverless fleet.

Read the Las Vegas permit report.

Cybercab creates a separate compliance question

Tesla’s future Cybercab is designed as a purpose-built driverless vehicle without conventional controls such as a steering wheel and pedals. That creates a different federal issue from PE24031: whether a vehicle with that design can comply with existing Federal Motor Vehicle Safety Standards, or requires an exemption.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

As of the latest cited coverage, Tesla had not sought the same type of federal exemption for Cybercab that NHTSA approved for Zoox’s purpose-built vehicle. Zoox’s exemption concerns Zoox’s vehicle and operating framework; it does not clear Tesla’s technology or Cybercab.

NHTSA’s 2026 policy changes are making automated-vehicle exemptions and deployment pathways more flexible, but regulatory flexibility is not a clean bill of health for any particular manufacturer.

See NHTSA’s 2026 automated-vehicle policy announcement.

What the investigation means—and what it does not

It means NHTSA’s safety investigators considered Tesla’s proposed transition from supervised driver assistance to driverless ride-hailing important enough to request detailed information about validation, operating limits, remote assistance, and incident handling.

It does not mean NHTSA has declared Tesla’s robotaxi system defective. It does not prove that FSD caused the four reported crashes. It does not establish that the SEC, DOJ, or NTSB were investigating the robotaxi rollout specifically. And it does not guarantee that Tesla’s announced cities, fleet sizes, or timelines will occur as projected.

The central regulatory question is straightforward: can technology designed to operate with an attentive human fallback remain safe when that fallback is removed, especially when visibility deteriorates or a situation falls outside the vehicle’s validated experience? PE24031 is part of the federal effort to obtain the evidence needed to answer it.
