Tesla denied that a 2021 Model 3 or its Autopilot system was defective in a wrongful-death lawsuit over a fatal 2022 crash in Clear Creek County, Colorado. That denial is Tesla’s position in the litigation, not a court finding. The lawsuit also raised a separate claim about the car’s flammability.
What happened in the Colorado crash?
Hans von Ohain was driving a 2021 Tesla Model 3 when it struck a tree and caught fire in Clear Creek County in 2022. The passenger escaped, according to the Associated Press account of a wrongful-death complaint filed by von Ohain’s widow, Nora Bass, on May 3, 2024.
The AP also reported that a Colorado State Patrol report said von Ohain was intoxicated at the time. That reported detail does not, by itself, resolve the lawsuit’s claims about the vehicle or explain how the crash and fire occurred.
What did the family allege?
Autopilot and the crash
Bass’s complaint alleged that Autopilot prevented von Ohain from keeping the Model 3 on the road. This is the family’s allegation about crash causation, not an established finding about what the system did.

Flammability and the fire
The complaint also alleged a vehicle-flammability defect. That is a distinct issue from what caused the car to leave the road: the cause of the crash and the severity or consequences of the post-crash fire require separate evidence. The cited accounts do not establish that the battery or another component caused the Colorado fire.
What did Tesla say in its court response?
Ars Technica reported on June 28, 2024, that Tesla denied an Autopilot defect caused or contributed to the death and denied that the Model 3 was defective or unreasonably dangerous. The article quoted Tesla’s response: “The product in question was not defective or unreasonably dangerous.” Ars also reported that Tesla suggested the vehicle might not have been in the same condition at the crash as when it left Tesla’s custody. These are Tesla’s litigation positions, not findings by a judge or a conclusive technical determination. Ars Technica’s report describes the response.

Was the Model 3 found to be defective, or did Autopilot cause the crash?
The cited reporting does not establish a court ruling on either question or the lawsuit’s current status. The family alleged that Autopilot prevented the driver from staying on the road and separately alleged a flammability defect; Tesla denied the alleged defects. Without a ruling or verified technical findings specific to this crash, neither allegation nor denial should be treated as a proven conclusion.

The NTSB report concerns a different crash: a September 2021 incident in Coral Gables, Florida, involving another Model 3 and two fatalities. The NTSB concluded that excessive speed led to the driver’s failure to control that vehicle; impact damage to its battery led to a post-crash fire.
