The SEC closed its investigation into Fisker in September 2025, according to information the agency provided in response to a FOIA request and that TechCrunch reported on February 13, 2026. Fisker’s separate Chapter 11 liquidation case continued to show court activity in 2026. The closure does not establish whether the SEC found wrongdoing: the reporting says the investigation’s depth was unclear, and no securities-law finding was reported.
Is the SEC still investigating Fisker?
According to TechCrunch’s account of an SEC FOIA response, the investigation was closed in September 2025. The closure was reported on February 13, 2026; it was not described as a public SEC announcement explaining the investigation’s outcome. TechCrunch said the agency did not disclose how far the investigation had progressed, and an SEC spokesperson declined to comment. TechCrunch’s report is the source for the closure date.
The SEC had disclosed in an October 2024 bankruptcy filing that it sent Fisker subpoenas for documents as part of an investigation into possible federal securities-law violations. That filing and the Commission’s objection to parts of the liquidation plan described a pending investigation at that time; they did not amount to a finding that Fisker or any person broke the law. The reported SEC objection asked that the plan preserve the agency’s regulatory powers and access to company records.
What the reported closure does—and does not—mean
The FOIA response reportedly said the investigation was closed in September 2025. TechCrunch also reported that the SEC FOIA department identified approximately 21.7 gigabytes of electronically maintained records related to the probe. That figure describes records volume, not evidence of misconduct, the number of findings, or an enforcement action.

The available reporting does not establish that the SEC publicly announced a securities-law violation or brought an enforcement action against Fisker in connection with this investigation. Nor does it explain the investigation’s scope or findings. The procedural facts should therefore be described as an investigation that was opened, involved subpoenas, and later closed—not as proof of wrongdoing or exoneration.
Fisker’s bankruptcy case is a separate track
Fisker and certain affiliates filed for Chapter 11 bankruptcy protection in Delaware in June 2024. The case portal gives June 17, 2024 as the petition date. Fisker used the bankruptcy process to sell its remaining Ocean inventory and liquidate other assets, according to TechCrunch. The cited reporting does not establish the terms or proceeds of every asset sale, or the current condition of every vehicle.

The bankruptcy court confirmed the joint liquidation plan on October 16, 2024, and the plan became effective the next day. Plan confirmation is not the same as completing every remaining task in the bankruptcy case: claims administration and other court-supervised work can continue after a liquidation plan takes effect.
The Verita case portal lists case activity in 2026, including claims-objection matters and an omnibus hearing listed for October 13, 2026. Docket schedules can change, so consult the live portal for the current status rather than treating a listed future hearing as certain.
