Overweight Farm Trucks Could Bring Heavy Penalties: What U.S. Drivers Need to Know

Farm use alone does not excuse an overweight truck. Federal safety exemptions are separate from weight rules, while state limits, allowances, permits and penalties vary.

Yes. A farm truck can be cited and penalized for exceeding an applicable weight limit; farm status does not create a nationwide exemption. The controlling limit and any penalty depend on the route, state law, vehicle and axle configuration, registration weight, load, and whether a specific agricultural allowance or permit applies. There is no single U.S. fine amount.

Farm-truck exemptions do not generally waive weight limits

A “covered farm vehicle” is a defined federal category, not a blanket pass from road rules. Qualification depends on factors including who operates the vehicle, what it carries and why, state identification, hazardous-material status, weight, and where it travels. For vehicles over 26,001 pounds, the definition includes additional in-state or 150-air-mile travel limits. Check the FMCSA covered farm vehicle definition for the applicable conditions.

When a vehicle qualifies, the covered-farm-vehicle provisions address specified federal commercial-driver safety requirements, including certain CDL, hours-of-service, driver-qualification, and inspection, repair, and maintenance requirements. Those provisions do not themselves authorize exceeding axle, gross-weight, or other applicable highway limits.

Which weight limits may apply?

Weight rules can involve several different measures. The limit that matters may be based on a single axle, a tandem axle, the vehicle’s gross weight, the weight allowed by its registration, or the relationship between axle spacing and total weight under a bridge formula. Meeting one limit does not automatically mean the truck meets the others.

For the Interstate System, 23 U.S.C. §127 generally sets a 20,000-pound single-axle limit, a 34,000-pound tandem-axle limit, and an 80,000-pound gross-weight maximum, alongside a bridge formula. The statute contains qualifications, grandfather provisions, and exceptions, and permits can be available for certain non-divisible loads under applicable state law. These figures are not a complete rule for every truck or every road: state and local routes may have different limits or restrictions.

When can a state agricultural allowance apply?

Some states provide conditional allowances for particular farm operations, commodities, roads, or trips; others limit farm vehicles to their registered weight. Do not assume an allowance applies just because the vehicle is used for farming. Confirm the commodity, route, registration, distance, season, permit conditions, and other requirements in the current state statute or DOT guidance.

State What the cited state guidance says What to check
Iowa Iowa DOT says trucks or combinations carrying qualifying raw agricultural products may operate up to 25 percent over registration weight in Iowa. The allowance is limited to qualifying raw products and Iowa; do not extend it to other commodities, states, or road rules. See Iowa DOT permit requirements.
Pennsylvania PennDOT says a registered farm vehicle may not be operated above its registered gross weight; permits may be available for oversize or overweight hauling under the Vehicle Code. Check the vehicle’s registration and whether a permit is available for the proposed trip. See PennDOT farm-vehicle size and weight limitations.

These are contrasting examples, not a nationwide standard. An older FHWA compilation of state truck size and weight laws also documents state-specific agricultural provisions, but its age makes it unsuitable as a substitute for checking current state law.

How penalties vary by state

States set their own penalty structures, and the amount can depend on the excess weight, whether the violation concerns an axle or gross weight, and whether a specific agricultural provision applies. The following examples illustrate variation; they are not a ranking or a prediction of what another state will charge.

North Carolina

North Carolina General Statutes §20-118 sets graduated civil penalties for specified single-axle and tandem-axle violations. For the schedule described in the statute, the rate starts at four cents per pound for the first 1,000 pounds or part of that amount, six cents per pound for the next 1,000 pounds or part, and ten cents per pound for each additional pound. The applicable subsection and violation type matter, so this is not a universal formula for every overweight citation. See the North Carolina statute.

South Carolina

South Carolina Code §56-5-4450 makes specified overweight operation a misdemeanor and provides per-pound penalties for gross-weight violations. It also sets a reduced rate for qualifying raw farm or forest products hauled from farm or forest to first market. Its axle and gross-weight provisions differ from North Carolina’s; consult the provision for the particular violation rather than applying another state’s schedule. See the South Carolina statute.

Do agricultural hours-of-service exceptions let a truck carry more?

No. Hours-of-service relief concerns driving-time and related logging requirements, not permission to exceed weight limits. FMCSA describes conditional agricultural hours-of-service exceptions, including a 150-air-mile framework for qualifying transportation, in its agricultural HOS guidance.

A 2026 example makes the distinction explicit: an FMCSA fertilizer waiver that applied from May 26 through August 26, 2026, and has expired, stated that it did not waive applicable vehicle size or weight limitations. It is not current relief. See the FMCSA 2026 fertilizer waiver.

What to verify before hauling

Because the applicable rule can change with the route and load, verify the whole trip before loading or dispatching the truck:

  1. Map the route. Identify whether each segment is Interstate, state highway, or local road, and check route-specific restrictions.
  2. Confirm the truck’s weights. Check axle and gross weights, axle spacing, bridge-formula implications, and the gross weight allowed by the vehicle’s registration.
  3. Check the claimed agricultural exception. Confirm that the operator, trip purpose, commodity, distance, identification, and any other conditions meet the current rule.
  4. Check permit requirements. Obtain any required permit and follow its route, timing, and operating conditions before moving an overweight load.
  5. Confirm who may be liable. Read the state rule for the specific violation; penalties and responsibilities can depend on the provision and may involve more than the driver.

Use the relevant state DOT or statute for each jurisdiction on the route. Without the state, truck configuration, registration, route, and commodity, an exact penalty or exemption cannot be determined.
