NHTSA opened a preliminary evaluation of model-year 2023 Fisker Ocean SUVs on February 14, 2024, after four complaints described difficulty shifting into Park or the intended gear and potential unintended movement. One complaint alleged an injury; the opening record listed no fatalities. The probe was an assessment of a possible safety issue—not a finding that a defect had been proven. Fisker later reported a software-update recall remedy that added Automatic Vehicle Hold.
What prompted NHTSA’s investigation?
NHTSA’s Office of Defects Investigation (ODI) opened Preliminary Evaluation PE24005 after reviewing vehicle-owner questionnaire reports. Its opening resume lists four ODI complaints involving model-year 2023 Fisker Ocean vehicles and an estimated population of 4,000 vehicles. The complaints described an “inability to shift into park” or a vehicle “not shifting into the intended gear,” with possible unintended movement or rollaway. One complaint alleged an injury; the resume recorded no fatalities. NHTSA’s opening resume does not establish how often the condition occurred across the fleet.
The complaint count is not a failure rate. The 4,000 figure is NHTSA’s estimated population in the opening record, not a count of confirmed affected vehicles. Complaint reporting and an estimated vehicle population do not amount to a verified incidence study, so dividing four by 4,000 would not produce a defensible estimate of an owner’s risk.
What does “preliminary evaluation” mean?
A preliminary evaluation is an early stage in NHTSA’s defect-investigation process. The agency reviews complaints and other information, and may seek information from the manufacturer or pursue more detailed analysis if warranted. Opening an evaluation does not prove that a defect exists or determine its cause. NHTSA said the purpose of PE24005 was to determine the scope and severity of the potential problem and assess the possible safety issues.

There is no fixed number of complaints that automatically triggers an investigation. NHTSA says the decision depends on factors including the size of the vehicle population and the severity of the possible consequences. A small complaint count, on its own, therefore neither proves a widespread problem nor rules out a safety concern.
What was the reported recall remedy?
Fisker’s recall report describes a software remedy: OS 2.0, which the report says was released to U.S. Ocean vehicles on March 11, 2024, and added Automatic Vehicle Hold (AVH). According to the report, AVH holds the vehicle after the driver presses the brake while stopped and in gear, then releases when the accelerator is pressed. NHTSA’s recall information is the appropriate place to check recall details. The material available here does not establish the remedy status for any particular VIN or whether service is currently available.

Why was this called a “second probe”?
The phrase referred to the wider sequence of NHTSA investigations involving the Ocean, not to an earlier rollaway investigation. On May 8, 2024, NHTSA opened a separate preliminary evaluation, PE24013, concerning allegations of inadvertent automatic emergency braking. That was a different alleged issue from the gear-selection and rollaway complaints in PE24005.
TechCrunch used the “second probe” framing in its February 16, 2024, report on the rollaway complaints. The report’s headline should not be read as saying NHTSA had already opened another rollaway case.

What happened after the probe opened?
Fisker’s recall report says the company and ODI met on October 31, 2024, to discuss remaining questions about PE24005 and agreed that Fisker would initiate a voluntary safety recall. The report says PE24005 would close. These records document the opening and the reported recall action, but do not establish the investigation’s live status as of October 8, 2026. For current status or a vehicle-specific recall check, consult NHTSA’s live records rather than inferring status from the earlier documents.
