For a nonconforming vehicle, the key federal age thresholds are 25 years for NHTSA safety rules and, under a separate EPA pathway, 21 years for emissions. The thresholds do not mean the same thing, and meeting either one does not automatically satisfy the other or guarantee state registration.
Before paying for a car or arranging shipment, identify its exact manufacture date, engine configuration, certification status, and intended use. Then check the federal route for each agency and ask the destination state whether it will title and register that specific vehicle.

How the federal rules fit together
There is no single “kei car import exemption.” The National Highway Traffic Safety Administration (NHTSA) administers federal motor vehicle safety requirements, including the Federal Motor Vehicle Safety Standards (FMVSS). The Environmental Protection Agency (EPA) administers federal vehicle emissions requirements. Each agency has its own rules, declarations, and criteria. A vehicle that qualifies under one agency’s age-based rules may still need to qualify separately under the other agency’s requirements.

The rules below concern vehicles treated as motor vehicles under federal law. NHTSA describes a motor vehicle as a mechanically powered vehicle manufactured primarily for use on public streets, roads, and highways. A seller’s label—“kei car,” “mini-truck,” or otherwise—does not resolve its legal classification. Check the vehicle’s design and intended use against NHTSA’s vehicle-classification guidance.
When NHTSA’s 25-year rule applies
NHTSA says a vehicle that is at least 25 years old may be imported without regard to FMVSS compliance. The agency counts from the vehicle’s manufacture date, not simply from the model year. This distinction matters for a vehicle built late in a model year: its model-year label alone might not show that it has reached the 25-year threshold on the planned import date.
Use the manufacture date shown on the vehicle’s label when available, and retain evidence supporting the date. If the label does not establish the vehicle’s age, NHTSA identifies records such as an invoice showing first sale or an old registration document as possible supporting evidence; a statement from a recognized vehicle historical society may also support an age determination. The age exemption addresses federal safety-standard compliance. It does not, by itself, answer the EPA question, establish that the vehicle is free of other import requirements, or require a state to title it. An importer should not treat “25 years old” as a universal clearance label.
What changes if the car is under 25 years old
A nonconforming vehicle younger than 25 generally cannot be permanently imported unless NHTSA has determined that it is eligible for importation. NHTSA eligibility decisions apply to a particular make, model, and model year; a decision for one vehicle does not establish eligibility for every kei car or every year of a model.
If the exact vehicle is eligible, it must be imported through a NHTSA-registered importer (RI), or by a person who has a contract with an RI to perform the required conformity work. The RI route is not an automatic waiver: the vehicle must meet the agency’s eligibility requirements and any required work must be handled through the applicable process. Check the exact make, model, and year against current NHTSA information and confirm directly that an RI is prepared to handle that vehicle. NHTSA provides information about eligibility for nonconforming vehicles and a registered-importer resource; verify the importer’s current status rather than relying on an old listing or seller’s assurance.

If the car is under 25 and there is no applicable NHTSA eligibility decision, do not assume that paying for modifications or hiring an importer will make permanent import lawful. The eligibility determination is a prerequisite to the RI route described here. Confirm the legal basis before the vehicle is shipped.

EPA’s separate 21-year emissions pathway
EPA describes an age-based pathway for a vehicle at least 21 years old in its original, unmodified configuration. For the engine-equivalence approach, the engine must be identical to the one originally installed: the same model and configuration. A vehicle that has been modified or fitted with a different engine may therefore fail a condition that an apparently similar, original example meets. EPA’s vehicle and engine import guidance, shown as updated September 1, 2026, outlines the overall rules; its import procedures explain the original-configuration and replacement-engine conditions in more detail.
The 21-year threshold is not a substitute for NHTSA’s 25-year safety threshold. A car old enough for the EPA pathway may still be too young for NHTSA’s age exemption. If it is nonconforming and under 25 years old, NHTSA’s eligibility and RI rules still need to be addressed independently.

EPA’s Form 3520-1 material describes vehicle age using the calendar year of manufacture subtracted from the year of import. That is not the same description as NHTSA’s manufacture-date calculation. Read the current EPA form instructions for the vehicle’s exact entry basis instead of assuming that a model-year label or a calculation used for one agency settles the other agency’s test. If the engine, modifications, or age calculation leave uncertainty, EPA advises prospective importers to contact its Imports Hotline.
Federal forms and declarations
Expect separate federal declarations. NHTSA’s HS-7 Declaration addresses safety, bumper, and theft-prevention standards; EPA identifies Form 3520-1 for passenger vehicles and highway motorcycles. The form names do not mean that the agencies share an exemption or make the same age determination. Review the current revisions and instructions, and make sure the declared entry basis matches the actual vehicle and its documentation.
- NHTSA: Use the applicable HS-7 declaration basis for the vehicle’s safety status. The agency’s HS-7 declaration provides the form; verify that you have the current version and instructions before entry.
- EPA: Use the applicable EPA declaration for the vehicle category and emissions basis. EPA’s publications and forms page identifies Form 3520-1 for passenger vehicles and highway motorcycles and lists forms and related material.
Keep the documents that substantiate the facts declared: manufacture-date evidence, records of original engine identity and configuration, and any relevant eligibility or RI arrangements. The agencies’ forms and guidance should be checked close to the planned import, since a form revision or entry requirement may change. This article does not assign a particular HS-7 box or EPA declaration basis to a hypothetical car; that depends on its facts and the current instructions.

A practical check before buying or shipping
- Identify the exact vehicle. Record the make, model, model year, manufacture date, engine identity and configuration, and whether the vehicle was built primarily for public-road use. Ask the seller for clear documentation rather than relying on a broad description such as “25-year eligible.”
- Establish the NHTSA route. If the vehicle will be at least 25 years old on the planned import date, assemble age evidence and confirm the applicable HS-7 declaration basis. If it will be younger and lacks the original U.S. certification, check the exact make/model/model-year eligibility status. If eligible, confirm the RI arrangement and required conformity work before committing to shipment.
- Establish the EPA route independently. Confirm whether the vehicle satisfies EPA’s age and original-configuration conditions, including the required engine identity. Review the current Form 3520-1 instructions for the exact entry basis; contact EPA’s Imports Hotline if a material fact is unclear.
- Ask the destination state about registration. Contact the DMV or other appropriate state agency with the exact vehicle details, intended road use, and the federal documents you expect to receive. Ask about titling, registration, inspections, classification, and any limits on use before purchase or shipment.
- Keep the timeline in view. A vehicle that has not yet reached an age threshold on the intended entry date does not qualify merely because it will turn 25 or 21 later. A younger vehicle’s NHTSA eligibility and RI process also need to be settled before import. Recheck dates and requirements if shipment or entry is delayed.
This sequence is designed to surface a disqualifying fact while the transaction can still be changed. The crucial details are vehicle-specific, so a seller’s general statement about “kei car rules” is not a substitute for verifying the actual vehicle, the planned import date, and the state where it will be used.
State title and road use are a separate decision
NHTSA directs importers to ask the relevant state agency about titling, registration, and operation. Its vehicle importation guidelines point readers to state requirements, and an agency interpretation notes that registration and licensing are generally matters of state law. State rules can turn on the vehicle’s classification, proposed use, inspection requirements, and the documents presented. Ask about the exact kei car, not just the general category, and describe whether it is intended for public-road driving or another use. If a state will not title the vehicle for the use you have in mind, federal import clearance will not change that state decision. No particular make, model, or destination state is specified here, so state eligibility must be confirmed directly.

How to compare two candidate kei cars
When choosing between vehicles, compare the details that control the import path rather than treating age or model name as a shortcut. A slightly older example with documented manufacture date and original engine may present a different federal case from a newer, modified car; either still needs a state-specific answer.

Do not assign a universal RI cost or assume that a particular importer accepts a given kei model: those details are not established by the federal age rules and must be confirmed directly. Likewise, no general state-by-state outcome can be inferred from the vehicle’s age alone.
