Fisker’s reported inability to move Ocean vehicle data to a buyer-owned server briefly threatened its bankruptcy fleet sale to American Lease. The buyer told the court Fisker had said porting would not be possible; follow-up reporting said American Lease agreed to pay another $2.5 million for five years of technical support, allowing the transaction to proceed. The record does not explain the technical obstacle or establish which connected features work today.
What was at stake in the server-porting dispute?
Fisker Group’s June 28, 2024 Fleet Sales Agreement with American Lease covered up to 3,231 vehicles configured for the United States and Canada, with a maximum gross transaction price of $46.25 million. The vehicle exhibit provided for delivery “as is.” The agreement also included a limited, royalty-free, non-exclusive, non-assignable and non-sublicensable license to relevant software and developer work needed to operate and improve the vehicles, and said Fisker would use commercially reasonable efforts to facilitate access to subscription-based services. The agreement’s terms treated vehicle ownership, software rights and service access as distinct parts of the deal.
In an emergency objection reported October 10, 2024, American Lease said it had just been informed that the purchased vehicles’ data could not be ported to another server. The buyer’s filing put the issue starkly: “Now, on the eve of the October 9 Hearing, Buyer has just been informed that Porting of the Purchased Vehicles will not be possible.” InsideEVs reported the objection. Contemporary coverage said connected services such as remote access, diagnostics and software updates depended on those services.
That statement documents what American Lease said Fisker had told it; it does not identify why the move could not be made. The available reporting does not establish whether the obstacle involved engineering, intellectual-property rights, licensing, credentials, staffing or security. Nor does it prove that every connected function would have stopped or that the SUVs were permanently unusable.

How did the sale proceed?
On October 14, 2024, follow-up coverage reported that American Lease agreed to pay an additional $2.5 million for future technical support over five years, on top of the approximately $46 million fleet purchase. The report described the added support arrangement as the negotiated resolution to the immediate dispute. It does not establish how that support was implemented or whether the same connected services remain operational today.
What did the deal mean for Ocean owners?
In July 2024, TechCrunch reported that American Lease planned to work with the newly formed Fisker Owners Association to make spare parts and software support available to more than 2,500 owners. The report quoted bankruptcy judge Brendan L. Shannon describing American Lease as “functionally a purple unicorn” in its role buying the cars and working on support. That coverage described a plan tied to the sale, not a guarantee of current parts stock, response times or ongoing service coverage.

A separate August 2024 bankruptcy filing by TomTom describes licensed software and data services supporting Fisker vehicles in the United States and Canada. The filing establishes a third-party licensed-services dimension, but does not explain the porting problem or show that TomTom caused it.

- Physical ownership: American Lease was purchasing the SUVs, which the agreement listed for delivery as-is.
- Software rights: The contract granted a limited license to relevant software and developer work; it was not an unrestricted transfer of every software right.
- Cloud hosting and services: Subscription-based access was contemplated, but the contract’s language about commercially reasonable efforts did not itself guarantee that all services could be transferred or would run indefinitely.
- Ongoing support: The reported additional payment addressed future technical support, while the owners’ association plan concerned spare parts and software support. Neither report establishes the present scope of service.
Accordingly, a fleet buyer could acquire the physical vehicles without automatically acquiring control of every server, license or continuing service on which connected features might rely.

- The technical, legal or operational reason Fisker reportedly said porting was not possible.
- Which cloud-dependent functions, if any, were interrupted, and the current status of each function.
- How the five-year technical-support arrangement operated in practice or whether all support obligations were fulfilled.
- Current spare-parts availability and actual coverage for owners.
