The EU’s definitive countervailing duties apply to specified new battery-electric passenger cars originating in China—not every electrified vehicle or every car from a Chinese-owned brand. In force from 30 October 2024 for five years, the duties vary by exporter: 17.0% for BYD, 18.8% for Geely, 35.3% for SAIC and 7.8% for Tesla Shanghai. These are additional countervailing duties, not necessarily the full customs charge on an imported vehicle.
Which vehicles are covered?
The measure covers specified new battery-electric passenger vehicles designed principally to carry up to nine people and originating in China. The regulation sets out the relevant customs classification and exclusions. It does not automatically cover hybrids, nor does a brand’s Chinese ownership alone determine whether a particular car is covered: the vehicle’s origin and the applicable exporter classification matter. Regulation (EU) 2024/2754 defines the legal scope.
What are the definitive EU duty rates?
The final rates are specific to exporters or groups named in the regulation. They are countervailing duties and should not be read as the total customs burden on a vehicle.

The rates appear in the final regulation and the European Commission’s announcement. A car’s badge alone does not establish its origin or which rate applies.

Why did the Commission impose the duties?
The European Commission concluded in its investigation that the producers covered by the measure had benefited from subsidisation and that countervailing duties were warranted. That is the Commission’s stated basis for the decision, which China has challenged; it is not an uncontested finding.
When did the duties take effect, and how long do they apply?
The Commission opened its investigation in October 2023 and imposed provisional measures in July 2024. It adopted definitive duties on 29 October 2024, with application from 30 October 2024. The final measure provides for a five-year period and review procedures. It superseded the provisional rates. Earlier reports may quote the provisional rates—17.4% for BYD, 19.9% for Geely and 37.6% for SAIC—or figures from the Commission’s August 2024 draft disclosure. Those were earlier stages, not the definitive rates adopted in October. The provisional measure is recorded in Regulation (EU) 2024/1866.
Has China challenged the EU measure?
Yes. China requested consultations at the World Trade Organization on 4 November 2024. The WTO dispute record for DS630 documents that request. It does not establish the dispute’s final procedural outcome as of 4 October 2026.

Did the January 2026 price-undertaking guidance end the duties?
No such conclusion follows from the guidance alone. In January 2026, the Commission published guidance explaining how Chinese exporters could submit price-undertaking offers. That shows an offer process; it does not establish that an offer was accepted or that the duties were replaced. The guidance is available in the Commission’s price-undertaking announcement.
