Can EPA Let California Set Its Own Vehicle Pollution Rules?

California can seek a Clean Air Act waiver for its vehicle emissions standards, but the authority is conditional. Here is what EPA says happened to three rules in 2025—and what its 2026 congressional transmittals do and do not establish.

Yes, but not automatically. The Clean Air Act generally bars states from setting their own emissions standards for new motor vehicles, while giving California a conditional route to seek an EPA waiver. EPA says three named California vehicle rules were disapproved by congressional resolutions enacted in June 2025. That does not mean every California emissions rule or waiver ended, and EPA’s later transmittals of additional rules to Congress are not themselves disapprovals.

How can California set vehicle pollution standards?

Section 209(a) of the Clean Air Act generally preempts states from adopting emissions standards for new motor vehicles. Section 209(b) provides California with a waiver process: the state asks EPA to exempt its standards from that preemption.

EPA says it must grant a waiver unless the Administrator finds at least one of three things: California’s determination that its standards are, in the aggregate, at least as protective as applicable federal standards was arbitrary and capricious; California does not need the standards to meet compelling and extraordinary conditions; or the standards and their enforcement procedures are inconsistent with section 202(a) of the Act.

The process includes an EPA notice in the Federal Register, an opportunity for a public hearing and written comments, EPA’s review of those comments, and a decision. California may not enforce the covered rules until EPA grants the waiver. The waiver is therefore a specific statutory process, not an unrestricted state power to override federal standards.

What happened to the three California vehicle rules in 2025?

EPA announced on February 14, 2025, that it planned to transmit three California waiver rules to Congress. EPA later reported that congressional resolutions disapproving those rules were signed into law in June 2025.

This account describes EPA’s statements about those resolutions and the rules they named. It should not be broadened into a claim that Congress ended all California emissions standards or all California waivers.

Did EPA’s 2026 transmittals repeal more rules?

No. EPA’s July 22, 2026 announcement said the agency had transmitted four additional California waiver rules to Congress in June, concerning cars, trucks, lawn mowers, and other equipment. On July 22, EPA transmitted two more rules related to marine vessels and ports. A transmittal is a step in the congressional review process; the announcement alone does not establish that Congress disapproved those additional rules.

EPA Administrator Lee Zeldin characterized the transmittals as required by law. That is EPA’s position, not a judicial ruling.

Are California’s vehicle emissions rules still in effect?

There is no reliable blanket yes-or-no answer based on the actions described here. EPA says three named rules were disapproved in 2025, while its 2026 announcements concern further transmittals, not established congressional disapprovals. The status and enforceability of a particular rule can depend on the rule, the relevant model years, the jurisdiction, and subsequent legal or regulatory action.

EPA’s waiver overview says there are currently no waiver or authorization requests pending EPA action. That means no such requests are awaiting an EPA decision according to the overview; it does not decide the status of existing rules or litigation.

Can other states follow California’s vehicle rules?

California’s section 209(b) waiver is not a general waiver pathway available to every state. The EPA material distinguishes California’s motor-vehicle waiver from other states’ possible adoption of California nonroad standards under section 209(e)(2)(B). Nonroad equipment follows a separate authorization framework, so it should not be treated as the same process as a California car or truck waiver.

What remains uncertain about court challenges?

The EPA announcements establish the agency’s account of the 2025 congressional resolutions and its later transmittals. They do not, by themselves, establish the final status of court challenges to the 2025 action. A court filing has surfaced, but its procedural posture, later docket activity, and any final ruling are not verified here. Do not treat EPA’s view or a congressional action as equivalent to a final judicial resolution.
