A Texas lawsuit and a separate federal class action accuse Allstate and its subsidiary Arity of collecting detailed phone location and movement data through third-party apps and using it for insurance purposes. The figure of more than 45 million Americans comes from the plaintiffs and the Texas attorney general; it is an allegation, not a count established by a court.
What the Allstate lawsuits allege
The controversy involves two separate cases: an enforcement lawsuit brought by Texas and private litigation filed on behalf of consumers. Both focus on alleged collection of phone data tied to driving, but they are not the same case.
Texas’s state lawsuit
On January 13, 2025, the Texas Attorney General announced a lawsuit against Allstate and Arity. The Attorney General alleged that the companies unlawfully collected, used, and sold phone location and movement data gathered through software embedded in mobile apps, naming Life360 as an example. The release said the data was used in insurance decisions and described the alleged database as covering more than 45 million Americans and trillions of miles. Private federal litigation
On February 5, 2025, plaintiffs filed Arellano et al. v. The Allstate Corporation et al. in the U.S. District Court for the Northern District of Illinois. The complaint alleges that Arity’s software development kit (SDK)—a component app developers can integrate into an app—collected location, accelerometer and gyroscope readings, speed, and other movement-related details from phones. Plaintiffs allege that Allstate used resulting profiles, or made them available or sold them to other insurers, for underwriting and premium decisions. The Texas case is brought by the state. The federal case is private litigation that was later consolidated with related cases under the name In re: Allstate & Arity Consumer Privacy Litigation, master docket 1:25-cv-00407. The allegations in either case should not be treated as proof that every app named, every user, or every insurer was affected in the same way.
What does the “45 million” figure mean?
It is the scale of the database alleged by the Texas Attorney General and the private plaintiffs. The reviewed court materials do not establish that figure as a judicial finding, nor do they provide a separate verified population estimate or quantified consumer loss. The same qualification applies to the allegation that the data represented trillions of miles: it is a claim about the alleged dataset, not an independently validated measurement in the cited materials.

What the federal court has decided
In a 2026 ruling on defendants’ motion to dismiss, the Northern District of Illinois granted the motion in part and denied it in part. Judge Jeremy C. Daniel wrote: “For the reasons stated and as outlined in this order, the defendants’ motion is granted in part and denied in part.” The court rejected dismissal arguments on whether the consolidated complaint plausibly alleged data collection and lack of consent for the claims it addressed, while dismissing certain other claims. It discussed consent as an element of some causes of action and an affirmative defense for others. Read the court’s order.
This was a pleading-stage ruling, not a trial or final decision on liability. The order says the complaint’s background is “taken as true for purposes of the present motion.” That means the court assessed the legal sufficiency of allegations at this stage; it did not determine after trial that the alleged conduct occurred. The ruling also does not mean the entire lawsuit was dismissed or that every claim survived.

What app users can do
Users concerned about phone data can review location and motion permissions and the privacy settings and notices for apps they use. The court’s discussion reflects disputes about app notices and consent, with facts varying across users and claims. The cited materials do not establish that changing permissions or uninstalling an app reverses past data sharing or changes an insurance decision.
